헌법재판소의 폐지를 주장하는 국민의 목소리가 50%에 달하고 좌(左) 편향된 헌법 재판관의 평결을 신뢰하지 않는다는 목소리도 50%에 육박하거나 그 이상이다. 그런데도 헌법 재판관의 판결에 승복해야 한다고 하니, 지금의 헌법 재판관이 마치 부처님과 예수님과 천주님같이 전지전능한 신(神)인가? 라고 말하고 싶다.
헌법을 수호하고 법리에 따라 평결하여 자유민주주의 대한민국을 수호하는 최후의 보류인 헌법 재판관은 불법으로 대통령 탄핵소추안을 각하 하는 것이 정의이고 진실이며 진리이다. 헌법 재판관의 역사적 사명이며 시대적 소명이라고 생각한다. 국민이 직접 뽑은 대통령을 한두 명의 헌법 재판관에 의해 파면된다면 헌법재판소는 존재해서는 안 된다는 것이 필자의 생각이다.
그러므로 1987년 헌법개정특별위원회 위원으로 참석한 헌법특별위원이였던 필자는 그 책임을 통감하여 차기 개헌에서는 전지전능한 헌법재판소는 개정 및 폐지되어야 한다고 생각한다. 오늘의 헌법 재판관에게 헌법재판소의 존폐 운명이 달려 있다.
결코 헌법 재판관은 신(神)이 아니라는 것임을 자각하고 헌법을 수호하는 최후의 보류이며 국익이 최우선이며 국가의 운명을 좌우하는 중차대한 책무를 가지고 있다는 것을 스스로 깨닫고 대통령 소추안을 평결하기를 간절히 바란다.
