국민의힘 국회의원의 전원 사퇴로 국회의 해산이 답이라는 윤상현 의원의 폭탄 발언에 실오라기만 한 희망을 걸어본다.
현행 헌법은 국회는 200명에서 300명으로 구성한다. 그런데 동시에 101명의 국회의원이 사퇴하면 199명의 국회의원으로 국회가 구성되지 않아 국회는 자동 해산되고 총선을 해야 한다. 다수 야당의 입법 독재와 줄 탄핵을 막는 길은 이 방법밖에 없다.
그러므로 윤상현 의원의 주장대로 국민의힘 국회의원 101명이 동시에 사퇴하면 총선을 다시 할 수밖에 없는 것이다. 단, "비례대표 국회의원은 당이 제명한 후 무소속 국회의원에서 사표를 내야 한다."
현행법으로는 더불어민주당 입법 독재와 줄 탄핵을 막을 수가 없다. 1987년도 헌법 개정을 할 때 대통령의 일인 독재만 생각했지, 다수 야당의 입법 독재와 줄 탄핵으로 국정 마비와 국헌을 문란하게 하리라고는 생각을 못 했다. 그러므로 대통령 5년 단임제와 대통령 탄핵은 있어도 국회해산권을 두지 않았다. 그런데 더불어민주당이 이재명 대표를 위하여 국회를 이렇게 운영하리라고는 누구도 생각하지 못했고 지금까지 한 번도 국회를 악용하지 않았다.
그러나 다수 야당의 제왕적 국회가 현실적으로 국가안보와 경제 파탄으로 국가의 최대위기를 맞이하고 국론분열과 국민 갈등을 부추기고 있어도 대통령의 국회해산권이 없는 헌법으로서는 지금 이 상황을 막을 길이 없다. 대통령 탄핵 반대와 인용을 두고 국론이 양 갈래 나누어지고 있다.
대통령 탄핵이 각하되고 기각되어 대통령이 복귀된다고 하더라도 지금의 다수 야당의 임기가 대통령 임기보다 더 많이 남아있는 한 달라질 것이 하나도 없다고 믿는다. 오히려 국론분열만 더욱 심화하고 국가안보와 경제 파탄과 국민의 불안과 민생은 더 나빠질 수 있다.
정답은 국회를 해산하고 총선에서 국회의원을 다시 선출하여 새로운 국회를 구성하는 길밖에 없다. 그러므로 국회해산 방법은 집권당인 국민의힘 108명 국회의원 모두가 동시에 사퇴하는 길밖에 없다는 윤상현 의원의 폭탄 발언인 국회해산이 될 수밖에 없다. 조기 대선 운운하는 국민의힘 잠룡들이 설사 재집권하여 대통령을 바꾸고 당선되어 재집권한다고 해도 지금의 다수 야당 국회의원의 임기가 남아 있는 한 바뀔 것은 하나도 없다.
오히려 혼란과 갈등 속에 분열되어 국격은 떨어지고 국론분열과 민족 갈등 및 대립과 반목으로 나라와 국민은 혼란과 불안으로 더욱더 위태롭게 된다는 윤상현 의원의 말에 필자는 적극적으로 동의한다.

대통령 탄핵 각하 및 기각이 된다면 윤석열 대통령 복귀 후에도 국민의힘 108명 국회의원 전원 사태만이 국회 구성이 성립되지 않아 국회해산과 동시에 총선을 통해 새로운 국회를 구성할 수 있다.
새로 구성될 총선에서 국가와 국민이 원하는 국가관과 사명감이 있는 건강한 여당과 건전한 야당 국회의원을 국민이 선출하는 것이다. 윤상현 의원의 주장처럼 국민의힘 국회의원들의 애국심과 용기가 있을지 국민들은 실오라기 같은 자동국회해산이라는 아주 작은 희망을 품어본다.
