[브레이크뉴스=배종태 기자] 한동훈 무소속(부산 북구갑) 의원은 24일 개정 정보통신망법, 이른바 ‘온라인 입틀막법’에 대해 “위헌이고 큰 혼란을 가져올 것”이라며 “시행하지 말고 즉시 재개정해야 한다”고 주장했다.
한 의원은 이날 페이스북에서 “7월 7일부터 개정 정보통신망법이 시행된다”며 “정부가 특정 정보를 혐오 표현과 같은 불법정보로 판단하면 온라인 플랫폼에 해당 정보의 유통을 차단하라고 명령하고, 이를 이행하지 않으면 형사 처벌하도록 규정하고 있다”고 지적했다.
이어 “하루 평균 이용자 수 100만 명 이상인 대규모 온라인 플랫폼은 불법정보와 허위조작정보 신고가 들어오면 삭제, 계정 정지 등의 조치를 취하고 결과를 보고서로 공개해야 한다”고 설명했다.
그는 특히 무엇이 허위조작정보인지 사실확인 단체가 결정하는 구조를 두고 “형식적으로는 사실확인 단체를 경유하지만 실질적으로는 정부가 무엇이 사실인지를 결정하는 구조”라고 비판했다.
그러면서 “정부가 무엇이 사실인지를 결정하면 정부 입맛에 맞지 않는 정보를 플랫폼이 스스로 걸러내는 검열 생태계가 구축될 것”이라며 “국민의 표현이 정부의 사전심사절차에 의해 금지되는 효과가 생긴다”고 주장했다.
또 “이런 시스템은 헌법 제21조 제2항이 규정한 사전검열금지원칙에 정면으로 위배된다”며 “정부가 불법이라고 판단하는 게시물을 포털이나 커뮤니티 사업자가 사전검열하도록 하고, 이를 따르지 않으면 사업자를 처벌하겠다는 것”이라고 했다. 그는 “사업자들은 처벌 위험을 줄이기 위해 더 많이 과잉 검열할 수밖에 없어 혼란과 폐해가 심각해질 것”이라고 전망했다.
한 의원은 “표현의 자유 헌법정신에 반할 뿐 아니라 공익적 문제제기도 위축될 것”이라며 “민주당이 억지로 통과시켰지만 7월 7일부터 시행되면 큰 혼란이 온다. 일단 법 시행을 유예하고 재개정 절차에 들어가야 한다”고 주장했다.

He particularly took issue with the structure in which fact-checking organizations decide what qualifies as manipulated information, saying, “Formally, the process goes through fact-checking groups, but in substance it is a structure in which the government decides what is true.” He argued that “if the government decides what is true, it will create a censorship ecosystem in which platforms automatically filter out information that does not fit the government’s preferences,” and that “the public’s expression will be effectively barred by a prior government screening process.”
He went on to say, “Such a system is in direct violation of the principle prohibiting prior censorship under Article 21, Paragraph 2 of the Constitution,” adding that it amounts to “having portal operators or community platform businesses pre-screen posts the government deems illegal, and punishing them if they do not comply.” He warned that “operators will have no choice but to engage in excessive self-censorship to reduce their risk of punishment, leading to serious confusion and harm.”
Han also argued that it “runs counter to the constitutional spirit of freedom of expression and will also discourage public-interest criticism,” and said that although “the Democratic Party pushed it through,” its enforcement on July 7 “will lead to major confusion.” He called for the law to be suspended before implementation and sent back for revision.
