백종헌 의원, 첨단재생의료 안전관리 강화 법안 발의...세포 배양 전문시설 처리 의무화

[브레이크뉴스=배종태 기자] 국민의힘 백종헌 의원(국회 보건복지위원회)이 첨단재생의료 분야의 안전관리 강화를 위한 '첨단재생의료 및 첨단바이오의약품 안전 및 지원에 관한 법률' 개정안을 대표 발의했다. 개정안은 저위험 재생의료 연구와 치료에서도 세포 배양 등 전문성이 필요한 공정은 전문 세포처리시설에서 수행하도록 해 안전관리의 사각지대를 보완하는 데 초점을 맞췄다.

 

백종헌 의원(부산 금정구)은 14일 재생의료기관의 인체세포 자가처리 범위를 합리적으로 조정하는 내용을 담은 「첨단재생의료 및 첨단바이오의약품 안전 및 지원에 관한 법률 일부개정법률안」을 대표 발의했다.

 

첨단재생의료는 인체세포 등을 활용해 희귀질환과 난치성 질환을 치료하는 미래 의료 분야로, 최근 관련 기술 발전과 함께 임상연구와 치료가 빠르게 확대되고 있다. 이에 따라 인체세포의 채취와 처리, 활용 전 과정에 대한 안전관리의 중요성도 커지고 있다.

 

현행법은 재생의료기관이 첨단재생의료를 시행할 경우 원칙적으로 전문 첨단재생의료 세포처리시설에서 공급받은 인체세포를 사용하도록 규정하고 있다. 다만 위험도가 낮은 임상연구나 치료의 경우에는 예외적으로 의료기관이 자체적으로 처리한 인체세포를 사용할 수 있도록 허용하고 있다.

 

하지만 최근 첨단재생의료 및 첨단바이오의약품 심의위원회가 배양된 자가 면역세포를 활용한 연구와 치료의 위험도를 중위험에서 저위험으로 하향 조정하면서 안전관리 공백에 대한 우려가 제기됐다. 위험도가 낮아질 경우 의료기관에서도 세포를 직접 처리할 수 있게 되지만, 세포 배양은 높은 수준의 전문성과 품질관리, 안전관리가 요구되는 공정이어서 전문시설에서 관리해야 한다는 지적이 제기되어 왔다.

 

개정안은 이러한 문제를 반영해 재생의료기관이 자체적으로 처리할 수 있는 범위를 인체세포의 단순 분리와 세척, 냉동, 해동 등 최소한의 조작으로 한정했다. 반면 세포 배양 등 최소 조작을 넘어서는 공정은 연구와 치료의 위험도와 관계없이 전문 세포처리시설을 거치도록 했다.

 

백 의원은 이번 개정안이 시행되면 저위험 재생의료 분야에서도 세포 배양과 같은 핵심 공정이 전문시설에서 이뤄져 안전관리 수준이 유지되고, 첨단재생의료 전반의 안전성과 제도적 일관성도 높아질 것으로 기대했다.

 

백 의원은 "첨단재생의료는 희귀·난치질환 환자들에게 새로운 치료 기회를 제공하는 중요한 분야인 만큼 무엇보다 안전관리가 우선돼야 한다"며 "이번 개정안을 통해 인체세포 처리의 안전성을 높이고 첨단재생의료에 대한 국민 신뢰를 강화하는 계기가 되길 기대한다"고 말했다.

Rep. Baek Jong-heon of the People Power Party has introduced legislation aimed at strengthening safety standards for advanced regenerative medicine by requiring specialized cell-processing facilities to handle cell culture procedures, even for low-risk clinical research and treatments. The bill seeks to close regulatory gaps created by recent changes in risk classifications.*

 

Rep. Baek Jong-heon (Geumjeong District, Busan), a member of the National Assembly's Health and Welfare Committee, on July 14 introduced an amendment to the **Act on the Safety and Support of Advanced Regenerative Medicine and Advanced Biopharmaceuticals**.

 

The legislation is designed to clarify the scope of cell processing that medical institutions may perform on their own while reinforcing safety oversight for procedures requiring advanced technical expertise.

 

Advanced regenerative medicine, which uses human cells to treat rare and incurable diseases, has expanded rapidly in recent years as new technologies have accelerated clinical research and therapeutic applications. The growth of the field has also heightened the need for rigorous safety standards throughout the cell-processing process.

 

Under current law, regenerative medicine providers are generally required to use human cells supplied by certified advanced regenerative medicine cell-processing facilities. An exception allows medical institutions to process cells in-house for low-risk clinical research and treatments.

 

However, concerns have emerged after the Advanced Regenerative Medicine and Advanced Biopharmaceutical Review Committee recently downgraded the risk classification of research and treatments using cultured autologous immune cells from medium risk to low risk. The reclassification could allow hospitals to culture cells themselves, despite concerns that cell culture requires highly specialized expertise as well as strict quality and safety controls.

 

Baek's bill would limit in-house processing by medical institutions to minimal manipulation of human cells, such as separation, washing, freezing, and thawing. Procedures involving more complex processing—including cell culture—would continue to require certified specialized cell-processing facilities regardless of whether the research or treatment is classified as low risk.

 

According to Baek, the proposed amendment would ensure that cell culture and other advanced processing procedures remain subject to appropriate safety oversight, strengthen the integrity of the regulatory framework for regenerative medicine, and enhance public confidence in emerging cell-based therapies.

 

"Advanced regenerative medicine offers new treatment opportunities for patients with rare and intractable diseases, making patient safety our highest priority," Baek said. "I expect this amendment to strengthen the safety of human cell processing and further increase public trust in advanced regenerative medicine."
