[브레이크뉴스=배종태 기자]무소속 한동훈 의원(부산 북구갑)이 더불어민주당의 보완수사 금지 추진 법안과 관련해 경찰이 영장 없이 시민을 무제한으로 체포할 수 있게 하는 위험한 독소조항이 포함되어 있다고 비판했다.
한 의원은 19일 자신의 사회관계망서비스(SNS)를 통해 민주당이 보완수사 금지를 추진하는 과정에서 경찰이 긴급체포 후 검사의 승인을 받을 필요조차 없도록 제도를 개악했다고 주장했다.
그는 현재 제도의 경우 경찰이 시민을 영장 없이 체포하면 12시간 이내에 검사의 승인을 받아야 하고 승인을 받지 못하면 즉시 석방해야 한다고 설명했다. 이는 긴급체포의 남용을 방지하고 시민의 인권을 지키기 위한 최소한의 안전벨트 역할을 해왔다고 강조했다.
하지만 민주당이 이번에 보완수사 금지를 추진하면서 기존의 검사 '승인' 절차를 '단순 사후 통보'로 슬그머니 변경했다고 지적했다. 이에 따라 민주당이 만든 세상에서는 경찰이 그 어떤 눈치나 견제도 받지 않은 채 시민을 영장 없이 무제한으로 체포할 수 있게 된다며 이러한 세상은 반드시 막아야 한다고 목소리를 높였다.
한 의원은 경찰 조직 자체의 문제라기보다는 견제 장치가 무너진 제도의 속성상 영장 없는 긴급체포가 필연적으로 남용될 수밖에 없으며, 그로 인한 피해는 고스란히 시민에게 돌아갈 것이라고 경고했다. 아울러 이러한 제도가 도입되면 과거 경찰의 영장 없는 긴급체포 악용 사례들이 일상이 될 것이라고 덧붙였다.
한 의원은 민주당 정권을 향해 경찰의 영장 없는 무제한 긴급체포 조항과 관련한 토론에서도 도망을 갈 것인지 따져 물었다.

Independent Lawmaker Han Dong-hoon(Busan BukGugab) strongly criticized the Democratic Party's legislative push for a supplementary investigation ban, claiming it contains a dangerous "poison pill" clause that would allow police to arrest citizens indefinitely without a warrant.
Through his social media account on the 19th, Lawmaker Han claimed that in the process of pushing for the supplementary investigation ban, the Democratic Party degraded the system so that police would not even need to obtain a prosecutor's approval following an emergency arrest.
He explained that under the current system, if police arrest a citizen without a warrant, they must secure a prosecutor's approval within 12 hours, and if approval is denied, the individual must be released immediately. He emphasized that this mechanism has served as a vital minimum safety belt to prevent the abuse of emergency arrests and safeguard citizens' human rights.
However, Han pointed out that the Democratic Party stealthily replaced the existing prosecutor "approval" process with a "simple post-facto notification" while advancing the supplementary investigation ban. He raised his voice, warning that in a world shaped by the Democratic Party, the police would be able to arrest citizens without a warrant and completely free from external oversight or checks, asserting that such a reality must be prevented at all costs.
Lawmaker Han warned that rather than being an issue of the police organization itself, the abuse of warrantless emergency arrests would become inevitable due to the inherent nature of a system where checks and balances have collapsed, with the resulting harm falling squarely on ordinary citizens. He added that if this system is implemented, past instances of police abusing warrantless emergency arrests would become a daily occurrence.
Finally, Han demanded answers from the Democratic Party administration, questioning whether they would also run away from holding debates regarding the clause that permits unlimited warrantless emergency arrests by the police.
