브레이크뉴스 정명훈 기자= 정치 브로커 명태균씨로부터 여론조사를 제공받고 후원자를 통해 비용을 대납하게 한 혐의로 재판에 넘겨진 오세훈 서울시장이 1심에서 벌금 1000만원을 선고받았다.
선출직 공직자의 경우 정치자금법 위반으로 징역형 또는 100만 원 이상의 벌금형이 확정되면 당선이 무효가 된다.
서울중앙지법 형사합의22부(부장판사 조형우)는 22일 정치자금법 위반 혐의로 기소된 오 시장에게 벌금 1000만원을 선고하고 2100만원의 추징을 명령했다.
함께 기소된 강철원 전 서울시 정무부시장에게는 벌금 300만원, 후원자인 사업가 김한정씨에게는 벌금 500만원이 선고됐다.
재판부는 이번 사건이 김건희 특별검사법상 수사·기소 대상에 해당한다고 판단했다. 명씨의 불법 선거 개입 의혹과 합리적인 관련성이 인정된다는 이유에서다.
재판부는 공소사실에 포함된 여론조사 10건 가운데 5건에 대해서는 오 시장 측의 의뢰와 김씨의 비용 대납 사실이 인정된다고 판단했다. 나머지 5건은 여론조사 의뢰나 비용 대납 사실이 충분히 입증되지 않았다고 봤다.
재판부는 "명태균씨의 진술 전부를 그대로 받아들이기는 어렵다"면서도 "카카오톡과 문자메시지, 여론조사 파일 전달 기록, 송금 내역과 시점 등 객관적인 증거와 부합하는 부분은 신빙성을 인정할 수 있다"고 밝혔다.
이어 "김씨가 별다른 이유 없이 거액을 지급했다고 보기 어렵다"며 "오 시장이 명씨에게 여론조사를 의뢰하고 김씨에게 비용을 대납하도록 요청한 사실이 인정된다"고 판시했다.
또 "여론조사 의뢰와 비용 대납 행위는 정치자금법의 취지를 훼손하는 것으로 죄질이 가볍지 않다"며 "오 시장이 오랜 정치 경력을 통해 정치자금법을 충분히 알고 있었음에도 책임을 인정하지 않는 태도를 보였다"고 지적했다.
재판부는 대납 금액이 2100만원에 이르는 점 등을 고려하면 공직 자격 상실에 해당하는 형의 선고가 불가피하다고 판단하면서도, 범행 기간이 비교적 짧고 실제 선거에 미친 영향이 크지 않은 점 등을 참작해 벌금 1000만원을 선고했다고 설명했다.
선고 직후 오 시장은 취재진들 앞에서 "납득할 수 없는 판결"이라며 "명씨의 진술과 간접 증거만으로 판단이 내려졌다. 항소심에서 다투겠다"고 밝혔다.
반면 김건희 특검팀은 "제출된 증거와 법리에 따라 판단한 재판부에 감사드린다"면서 "일부 무죄 판단과 벌금형이 선고된 만큼 판결문을 검토한 뒤 항소 여부를 결정하겠다"고 밝혔다.
오 시장은 2021년 4·7 서울시장 보궐선거를 앞두고 명씨로부터 공표 3건, 비공표 7건 등 총 10차례의 여론조사를 제공받고, 당시 비서실장이던 강 전 부시장을 통해 사업가 김씨에게 약 3300만원의 비용을 대신 지급하게 한 혐의로 지난해 12월 기소됐다.
