브레이크뉴스 정명훈 기자= 6·3 지방선거 당시 경기 지역 일부 투표소의 투표율 허위 입력 의혹과 관련, 중앙선거관리위원회와 경기도선거관리위원회 관계자들이 최종 투표율이 맞았다면 문제가 없다는 취지의 진술을 한 것으로 전해졌다.
24일 법조계에 따르면 검경 합동수사본부는 경기 지역 한 투표소에서 실시간 투표자 수가 잘못 입력된 사건과 관련, 이를 정정하는 대신 다른 투표소의 투표자 수를 늘리는 방식으로 수치만 맞춘 정황에 대해 수사하고 있다.
수사당국은 선관위 직원들의 내부 메신저 대화내용 확보를 통해 투표율 오입력에 대한 내용을 논의했으나, 상부에 별다른 보고 없이 수치만 조정하기로 의견을 모은 정황을 확보한 것으로 알려졌다.
피의자들 역시 조사 과정에서 허위 입력 사실을 인정하면서도 최종 투표율 자체를 조작한 게 아니기 때문에 선거 결과에 별다른 영향을 미치지 않았다는 취지로 진술한 것으로 전해졌다.
그러나 합수본은 실제와 다른 수치를 전산 시스템에 입력한 행위 자체가 형법상 공전자기록위작에 해당할 수 있다고 보고 있다.
형법 제227조의2는 공무원 또는 공무소의 전자기록을 위작하거나 변작해 사무처리를 그르치게 한 경우 10년 이하의 징역에 처하도록 규정하고 있다. 또 공직선거법 제249조는 투표를 위조하거나 그 수를 증감한 경우 1년 이상 7년 이하의 징역에 처하도록 규정하고 있으며, 선거사무 관계자가 범행한 경우에는 3년 이상 10년 이하의 징역으로 가중 처벌하도록 하고 있다.
다만 시간대별 투표 현황만 허위 입력한 사안에 대해서도 해당 조항이 적용될지 여부는 추가적인 법리 검토가 필요할 것으로 보인다.
한편, 합수본은 실무자뿐 아니라 상급자가 허위 입력 사실을 인지하거나 승인·묵인했는지 여부에 대해서도 수사를 이어가고 있다.
아울러 합수본은 투표용지 부족 사태와 관련해선 동작구선관위 사무국장을 피의자 신분으로 조사하고 있다. 이와함께 중앙선관위 선거1계 관계자 2명은 참고인으로 조사 중이며 노태악 전 선관위원장의 외유성 출장 의혹과 관련해서도 관계자 소환 조사를 진행하고 있다.
