최수진 의원, 전통시장 ‘점포 앞 상품진열’ 법제화 추진

 법적 충돌과 ‘고무줄 단속’에 갇힌 전통시장의 눈물

 

그동안 전통시장과 상점가에서는 이용객의 구매 편의와 시장 특유의 활기를 살리기 위해 점포 앞 일정 공간에 상품을 진열하거나 좌판을 설치하는 관행이 오랜 기간 유지돼 왔다. 하지만 이러한 현장의 관행은 현행 법 체계 아래에서 상위법과 자치법규가 정면 충돌하는 심각한 법적 사각지대를 만들어왔다.

 

현행 「도로법」 제61조는 공공 도로를 점용할 경우 반드시 행정청의 허가를 받도록 규정하고 있다. 하지만 시행령상 허가 대상이 비가리개, 전신주, 주차장 등으로만 한정돼 있어 상점 앞 ‘상품 진열용 좌판’은 원천적으로 허가받을 수 없는 ‘불법 적치물’로 분류돼 왔다. 이에 따라 도로를 무단 점용할 경우 변상금 부과 및 형사처벌 대상이 되는 구조적 한계가 존재했다.

 

일부 지자체에서는 전통시장 활성화를 위해 자치 조례로 황색선을 지정하고 선 내 영업을 묵인해 왔으나, 이는 상위법(도로법)의 위임을 받지 않은 조례에 불과해 법적 효력이 대단히 취약했다. 이로 인해 국민신문고 등에 악의성 민원이 단 한 건만 접수돼도 단속 공무원은 법 집행(과태료 부과 및 강제 철거)을 강행할 수밖에 없었고, 상인들은 언제든 범법자로 몰릴 수 있는 심각한 법적 불안정성에 시달려 왔다.

 

아울러 일관된 국가적 관리 기준이 없다 보니 지자체별, 담당 공무원별로 단속 기준이 제각각 적용되는 ‘고객선 관리의 형평성 문제’도 불거졌다. 일부 지역에서는 상인회와의 협의로 유연하게 관리되는 반면, 다른 지역에서는 엄격한 잣대로 과태료를 부과해 지자체 간 상인들의 불만이 고조되고 소모적인 행정력이 낭비되는 악순환이 되풀이되고 있는 상황이다.

또한 명확한 법적 통제 장치 없이 관행에만 의존하다 보니, 일부 점포에서 황색선을 무단으로 침범해 좌판을 과도하게 확장하는 폐단도 나타났다. 이는 휠체어나 유모차를 이용하는 교통약자의 보행권을 위협함은 물론, 화재 등 비상 상황 발생 시 최소 4m 이상의 소방차 진입로 확보를 어렵게 만들어 대형 인명 피해 위험을 상시 내포하고 있다는 지적을 받아왔다.

 

 ‘도로점용허가 특례’ 신설…안전·영업권 동시 확보

 

최수진 의원이 발의한 개정안은 상위법과 하위 조례 간의 충돌 및 법적 사각지대를 근본적으로 뿌리뽑기 위해 마련됐다.

 

이번 개정안은 「도로법」 제61조 및 제62조의 규정에도 불구하고, 지자체장이 전통시장 활성화를 위해 점포 앞 도로 일부에 상품 진열대 및 좌판 설치를 위한 도로점용을 허가할 수 있도록 하는 ‘도로점용허가 특례’ 규정을 신설(안 제17조의3 제1항)했다.

 

단, 무분별한 도로 점용을 방지하고 공공의 안전을 확보하기 위해 법률상 엄격한 필수 요건을 명시했다. 개정안은 △최소 보행 폭 이상의 보행 공간 상시 확보 △화재 등 긴급재난 시 소방차 등 긴급차량 통행 확보 △도로의 구조 안전 및 미관을 해치지 아니하는 한도 등을 도로점용 허가의 필수 전제 조건으로 규정했다.

 

이와 함께 점용의 구체적인 범위, 상품 진열 규격, 점용료 부과 및 감면 기준 등 세부적인 실무 집행 사항은 지방자치단체의 조례로 위임(안 제17조의3 제2항)하도록 했다. 이를 통해 각 지역 시장의 도로 환경에 맞춰 탄력적이고 현장밀착형 관리가 가능하도록 설계했다.
