아동학대 사건 사고가 끊임없이 터지고 있다. 올해 1분기 5,695건의 학대 신고 건수를 보면 지난해 같은 기간에 비해 무려 109%가 급증하여 2배가 늘었다. 이렇게 급증하게 된 이유는 코로나19로 인하여 가정에서 머무는 시간이 많기도 하지만, 정인이 사건 이후 사회적인 관심과 경각심이 높아져 과거에는 제대로 신고하지 않다가 신고하기 때문이다.

 

18세 미만의 영유아를 포함한 초•중•고 학생까지 아동에 포함되며, 아동학대는 보호자 또는 성인이 아동에게 신체적, 정신적, 성적 폭력을 가하거나 아동을 돌보지 않고 유기, 방임하게 되어 처벌받게 되는 경우를 말한다. 성장기 아동들이 신체적, 정신적으로 성장하는 시기에 학대를 받으면 성인이 되어서도 마찬가지로 다시 폭력을 행하기 쉽다. 가정폭력이 대물림되는 이유가 바로 부모에게 폭력을 당한 아이가 성인이 되어서 폭력을 행사하기 때문이다. 결국 유아기나 아동기에 부모로부터 학대를 받은 사람이 성장하여 부모가 되면 다시 자녀들에게 고스란히 학대의 경험을 되살려 학대를 하게 된다는 것이다.

 

아동학대를 하는 사람들의 타당하지 못한 이유나, 영문도 모르고 학대를 당하는 아동들 유형은 여러 가지로 많다. 그중에서 학대를 당하는 아동들 대부분이 취약계층에서 코로나19 재난으로 인하여 수면 위로 잘 드러나지 않고 고통을 받는 숨은 피해자들이다. 갈수록 경제적인 양극화와 사회적인 여러 문제로 인하여 여러 어려움을 겪는 가정에서 코로나 팬데믹까지 가중된 아동 양육의 양극화 문제까지 심각한 현실이다.

 

대부분 보편적인 가정에서 자라는 아이들이야 부모나 조부모 사랑을 듬뿍 받고 아주 행복한 모습으로 성장할 수 있지만, 취약계층 아동들은 충분히 부모 사랑을 받지 못하는 것도 안타까운데 학대까지 당하다니 이중고를 겪게 된다. 요즘 노년기에 접어든 사람들도 스마트폰 속에는 손주들 재롱부리는 모습이 동영상으로 저장되어 이 틈틈이 들여다보는 재미로 산다. 그리고 영상통화를 하면서 자주 못 만나도 서로 소통하면서 행복해한다. 반면에 취약계층 아동들은 부모의 돌봄도 제대로 받지 못하는데 경제적인 어려움이 겹치면서 비교당하고, 다양한 혜택을 받지 못하면서 학대까지 당하니 온전히 성장할 수 없을 것이다.

 

아동학대의 종류에는 물리적 학대와 정신적 학대가 있다. 물리적 학대는 물리적인 폭력으로 골절, 타박상, 열상 등을 유발하는 직접적인 학대가 있으며, 정신적 학대는 아동을 방치하거나 정신적인 스트레스 혹은 지나치게 강압적인 행동으로 발생하는 학대이다.

 

아동학대의 장소는 대부분 가정 안에서 일어나지만, 요즘 들어서 어린이집이나 유치원, 학교 내에서도 어처구니없는 황당한 사건들이 자주 일어나고 있다. 결국은 가장 가까이서 아동을 돌봐줘야 하는 보호자인 부모와 교사, 혹은 보호시설 안에서도 자주 발생하게 된다. 이는 보호해 줘야 할 의무를 지닌 사람들이 오히려 아동을 자기 소유물로 생각하고 갑질을 하거나 볼모로 잡고 함부로 대하는 태도이다.

 

전체 아동학대의 80%가 부모라 한다. 이런 부모들은 마치 훈육을 핑계로 신체적, 정신적인 학대를 하면서 습관적으로 자신의 잘못에 대한 불감증을 갖게 된다. 그러나 본인이 당장 어린아이로 돌아가 생각해 보면 얼마든지 아이의 잘못을 이해하고 용서해주면서 충분히 기다려 줄 수 있지 않은가.

 

16개월 정인이 사망 사건만 봐도 그렇다. 감히 상상조차 할 수 없는 부모의 횡포에 아무리 울어봐도 들어줄 사람 없는 아가였다. 단 한 번 그 누구에게도, 어디에도 하소연 못 하고 이유도 모른 채 학대와 폭력으로 죽어가면서 얼마나 고통스러웠을까. 그런 아동들이 예나 지금이나 끊임없이 발생하고 있다는 것과 앞으로 어떻게 잔인한 아동학대를 막을 수 있을까 하는 방법을 서둘러 찾아서 연구해야 한다.

 

아동학대 신고는 국번 없이 112, 1577-1391 또는 중앙아동보호전문기관 홈페이지나 아이지킴이콜 앱을 통하여 신고하면 된다. 신고할 때 피해 아동의 이름, 성별, 나이, 전화번호, 소속 교육기관, 학대 의심 내용을 말하고 학대 행위자의 이름, 성별, 나이, 전화번호, 주소, 피해 아동과의 관계, 직업 및 직장 등을 최대한 구체적으로 말하는 게 좋다. 그러나 신고 후에 발생하는 여러 가지 문제들도 짚어볼 필요가 있다.

사건 사고 난 후에 대처보다는 정확한 실태조사를 하여서 예방책 마련이 시급하다. 현재 아동학대 예방 전담 경찰관인 APO(Anti-abuse police officer)를 도입하여 아동학대 사각지대 문제해결을 위한 경찰청 본청을 비롯한 각 경찰서에 배치돼 활동 중이다. 학대 의심 신고 시 현장에 출동해 학대 정황을 가려내고 학대 위험에 놓인 아동을 지속적 모니터링을 하는 것이다. 그러나 대부분 부모에 의해 학대를 받으니 수면 위로 드러내기가 쉽지 않다. 따라서 아동 인권을 최우선으로 고려하고, 아동학대 사건 취재 시 언론이 준수해야 할 윤리를 지켜야 하며, 아동학대 예방에 관한 정확한 정보를 제공하며, 아동학대 예방교육을 실시해야 한다. 생명의 존엄성과 한창 맑고 푸르게 자라야 할 아동의 잠재적인 무한한 가능성을 개발하여 국가의 미래를 위한 짊어질 소중한 인격 형성의 책임이 어른에게 있다는 것을 명심해야 할 것이다.
