세종시선거여론조사심의위원회(이하 세종시여심위)는 제21대 대통령선거와 관련해 선거여론조사 결과를 왜곡해 공표한 혐의로 A씨를 5월 28일 세종경찰청에 고발했다고 밝혔다.
세종시여심위에 따르면, A씨는 이달 중순 세종지역 선거구민 500여 명이 참여하는 카카오톡 단체 채팅방에서, 특정 후보자에게 유리한 인식을 심어주기 위해 여론조사기관 3곳의 조사 결과를 의도적으로 왜곡해 게시한 것으로 드러났다.
현행 '공직선거법' 제96조 제1항은 선거 관련 여론조사 결과를 왜곡해 공표하거나 보도하는 행위를 명확히 금지하고 있다. 이를 위반할 경우 같은 법 제252조 제2항에 따라 5년 이하 징역 또는 300만 원 이상 2000만 원 이하 벌금형에 처해질 수 있다.
세종시여심위는 “선거여론조사는 유권자의 판단에 중대한 영향을 미치는 만큼 그 신뢰성이 무엇보다 중요하다”며 “이번 사례처럼 왜곡된 여론조사 결과를 유포하거나 공표하는 행위는 공정한 선거질서를 심각하게 훼손하는 중대한 위법 행위로, 선거일까지 위법행위에 대해 강도 높은 단속과 엄정한 조치를 이어갈 방침”이라고 밝혔다.
