공화정의 핵심 요체는 주권재민의 실현이라 할 수 있다. 국가 구성원 개개인의 권리가 특정한 사람의 의사에 따라 일방적으로 강압되지 않고 민주적 절차와 합의에 의해 행사되는 정치체제로, 세습적 군주제와는 확연히 구분된다.
우리나라 헌법 제1조 1항 [대한민국은 민주공화국이다]와 2항 [대한민국의 주권은 국민에게 있고, 모든 권력은 국민으로부터 나온다]로 규정되어 있다. 국가의 작동 원리와 주권이 국민에게 있음을 함축적으로 명시한 것이다.
대한민국은 헌법에서 규정한 바와 같이, 민주공화국 토대 위에 있다. 유권자에 의해 선출된 대표자가 한시적으로 위임된 권한을 행사한다. 아울러 행정부, 입법부, 사법부의 상호 견제를 통해 국가 조직의 일관된 건강성을 유지한다.
그러한 국가권력은 영토 방위와 주권수호, 국익을 위한 사명으로 수렴된다. 아울러 국민의 생명과 안전, 권리와 편익 증진을 위한 복무 자세가 부과된다. 거기엔 공화정 본래의 덕목인 공정, 자유, 정의 등과 같은 요소가 망라된다.
민주공화국은 국민 개개인의 출생과 신분 또는 정치적 의사결정 등에 따른 차별을 배격할 뿐만 아니라, 모든 유권자가 자신의 의지에 따라 평등하게 투표권을 행사한다. 국민주권 실현을 위한 본연의 정치체제라 할 수 있다.
인간을 보다 인간다운 삶으로 이끌기 위한 여정으로서의 민주공화국은 그 자체로 위대하다. 하지만 때로는 위협받기도 한다. 수적 우세를 앞세운 어느 한쪽이 일방적으로 독선을 행사하게 될 때 공동체의 운명은 위기를 맞는다.
국민에 의해 선출된 대표자들이 자신들의 정치적 이해득실에 따라 아무렇지도 않게 권한을 남용하고 강압을 행사한다면 공화정은 질색될 수밖에 없다. 대의 민주주의가 선거철에만 반짝 꽃을 피우는 듯한 한계가 뚜렷하다.
최근 법무부와 검찰청 수뇌부의 부당한 지시로 대장동 개발 비리 사건 1심 판결에 대한 항소가 좌절되는 초유의 사태가 발생했다. 공판 검사들은 물론이고, 전국 주요 18개 지청장인 검사장들도 그 부당함을 지적하고 나섰다.
이재명 정권에 의해 법치주의가 유린되고 짓밟힌 참사라 할 수 있다. 그에 따른 검사들 반발은 지극히 자연스러운 것이고, 또 바람직한 처사로 이해된다. 그것이 기소를 맡고 있는 검사로서의 존재 이유이며 책무인 까닭이다.
이에 대해 국회 법사위 간사인 더불어민주당 김용민 의원이 검사장 18명을 경찰에 고발했다. 정성호 법무부장관과 소통했다는 점도 밝혔다. 심지어 "고발하면 (정 장관이) 적극 협조하겠다는 취지의 답변을 했다"는 것이다.
우선 검사장들을 고발한 김 의원 행각이 매우 낯뜨겁고 괴이하다. 더욱이 정 장관은 대장동 개발 비리 사건 항소 포기와 관련해 직권남용 혐의로 경찰에 고발된 상태다. 어찌된게 도둑이 매를 든 것과 다를 바 없게 됐다.
한편 김민석 총리는 공무원 75만 명의 휴대전화를 털기로 했다고 한다. 비록 공무원이라는 신분상 특수성을 감안하더라도, 이는 명백한 인권침해에 해당된다. 권력을 이용한 기본권마저 해치는 듯싶어 경악하지 않을 수 없다.
연성독재의 점화이자 공포정치의 단면인 것만 같아 혼란스럽기 그지없다. 폭력적으로 읽히는 권력 운용 앞에서 취약한 우리 내부의 면모 또한 새삼 깨닫게 된다. 어떤 측면에서는 대국민 협박성 발언으로 인식되기도 한다.
즉각 멈춰야 한다. 최소한의 자기 검열도 담보되지 않은 채 권력의 칼자루를 휘두른다면, 그 후과는 어찌 감당할 셈인가? 수준 낮은 선동과 중우정치를 내려 놓고, 스스로의 역량 입증을 통해 국민께 다가설 수 있기를 충고하는 바다.
