국토부는 테슬라 FSD 기능을 무단 활성화할 경우 ‘자동차관리법’ 제29조에 따라 자동차 안전기준에 적합하지 않은 자동차로 판단돼 운행이 불가하며, 같은 법 제35조에 따라 자동차의 안전한 운행에 영향을 줄 수 있는 소프트웨어를 임의로 변경, 설치, 추가 또는 삭제하는 행위로 판단하고 있다.
이를 위반하는 경우 ‘자동차관리법’에 따라 2년 이하의 징역 또는 2000만원 이하의 벌금에 처하게 되므로, 이를 인지하지 못하고 국내 차주들이 무단으로 테슬라 FSD를 활성화하는 문제가 발생하지 않도록 당부했다.
