[브레이크뉴스=이성용 기자] 경상남도 특별사법경찰(이하 도 특사경)은 지난 6월 18일부터 8월 31일까지 낙동강 유역 내 무단으로 설치·운영한 불법 계류장에 대해 기획수사를 실시한 결과, 하천법을 위반한 계류장 4곳을 적발했다고 8일 밝혔다.
도는 낙동강 변에서 불법 계류장이 운영되면서 발생하는 하천오염과 안전사고를 예방하기 위해 이번 수사를 기획했다.
적발된 4곳 중 3곳은 낙동강 변에 무단으로 계류장을 설치하고 수상레저 활동을 목적으로 운영한 혐의로 기소 의견으로 검찰에 송치했다.
나머지 1곳은 원상복구 명령을 회피하기 위해 다른 장소로 이동해 운영하다 적발돼 현재 수사 중이다.
또한, 하천을 무단 점용해 관할 행정기관으로부터 원상복구 명령을 받았음에도 이를 이행하지 않고 계속 운영한 혐의도 함께 조사하고 있다.
특히, 이번에 적발된 A계류장은 개발제한구역인 하천구역 내에서 약 600㎡ 규모로 운영하다 적발됐으나, 원상복구 명령을 이행하지 않고 낙동강 하류로 약 2㎞ 이동해 400㎡ 규모의 계류장을 다시 설치·운영하다 추가 적발됐다.
A계류장은 하천구역뿐만 아니라 개발제한구역에도 해당돼, 개발제한구역의 지정 및 관리에 관한 특별조치법 위반 혐의도 추가됐다.
하천법에 따르면, 하천구역 내에서 하천관리청의 허가 없이 하천을 점용하거나 원상복구 명령을 위반하면 2년 이하의 징역 또는 2천만 원 이하의 벌금에 처해진다.
한편, 원상복구 명령을 이행하지 않은 계류장은 관할 기관에서 행정대집행을 예고했으며, 향후 이를 회피해 다른 장소로 이동·설치할 경우 드론 등 장비를 활용해 끝까지 추적·단속할 계획이다.
