[브레이크뉴스=배종태 기자] 박형준 부산시장이 최근 페이스북을 통해 현 정권의 행태를 정면으로 비판하며 대한민국 민주주의의 위기를 경고했다.
"87년 체제 40년, 성숙 아닌 천박한 민주주의 내리막길 페달 밟아"
박 시장은 "요즘 이 정권을 보면 레비츠키와 지블렛이 쓴 <민주주의가 어떻게 무너지는가?>라는 대본을 현실의 무대에서 입증하기 위해 안달인 것 같다"며 포문을 열었다.
박 시장은 87년 체제가 40년 가까이 되는 시점에 우리가 "성숙한 민주주의로의 오르막길이 아니라 천박한 민주주의로의 내리막길로 페달을 밟고 있다"고 진단했다. 그가 정의한 '천박한 민주주의'는 "권력을 잡은 자들이 다수의 이름으로 제멋대로 하는 민주주의"이며, 이는 "완장 민주주의, 선동 민주주의, 위선 민주주의 등 가짜 민주주의를 등에 업고 대한민국의 자유민주주의 체제의 근간을 흔들고 있다"고 강하게 비판했다.
"법의 지배 아닌 법에 의한 지배"… '완장 민주주의'가 국회마저 무너뜨려
박 시장은 특히 민주주의의 기본 원칙인 '법의 지배(법치)'가 훼손되고 있다고 지적했다. 그는 "완장 민주주의는 민주주의의 첫째 규범인 법의 지배가 아니라 법에 의한 지배로 나타나고 있다"며, 조희대 대법원장이 '세종대왕이 법을 왕권 강화의 통치수단으로 삼지 않고 백성의 권리를 보장하는 규범적 토대로 삼았다'고 발언한 것은 "바로 법의 지배를 법에 의한 지배로 바꾸려는 집권세력에 대한 우회적 경고"라고 해석했다.
현재 국회 상황에 대해서는 "국회가 이미 무너졌다"고 선언했다. 대한민국 국회법은 교섭단체 간의 협의와 합의에 의해 국회를 운영하라고 규정하고 있지만, "이미 민주당은 모든 쟁점 법안을 일방 처리하고 있다"며 '다수의 폭력'이 일상화되었다고 꼬집었다. 이어 "국회 선진화법의 원래 취지가 일방 처리를 하지 말라는 것인데 오히려 이를 악용해 모든 법안을 일방 처리하고 있다"며, 그렇게 처리되는 법안들이 대부분 "권력 강화의 통치수단"으로 기능할 법안들이라고 지적했다.
나아가 박 시장은 현 정권이 사법부를 향해 "검은 혀를 드러내고 있다"며, "심지어 교섭단체의 고유한 권한인 간사 선임도 가로막는다"고 비판의 수위를 높였다. 그는 "서울축구팀이 부산축구팀 주장 선임을 제 맘대로 하겠다는 꼴"이라며, "자유도 없고 공화도 없고 민주도 없다"고 개탄했다.
"거짓말에 낯빛 하나 변하지 않아"… '선동·위선 민주주의'의 도덕적 타락 지적
박 시장은 '선동 민주주의'의 행태가 "왜곡과 침소 봉대, 가짜 뉴스든 관계없이 표적을 무너뜨리기 위해서라면 서슴없이 이용"된다고 비판했다. 대법원장에 대해 있지도 않은 사실을 꾸며내어 퇴진을 압박하다가 거짓이 드러나자 "본인이 직접 수사를 받고 혐의를 벗으라"는 식의 행태는 "참으로 아이들 보기도 부끄러운 행태"라고 맹렬히 비난했다.
특히 책임 정치의 근간을 흔드는 '거짓말'에 대해 집중적으로 문제를 제기했다. 관세 협상에 대해 "합의문이 필요 없을 정도로 성공적"이라 발표했다가 이제 와서 "서명했으면 탄핵당했을 거라니요?"라고 반문하며, "민주주의의 책임 정치는 거짓말에 대해 가장 엄격하다. 하지만 이 정권만은 어제 얘기와 오늘 얘기가 달라도 낯빛 하나 변하지 않는다"고 비판했다. 나아가 이를 "마치 주권을 지킨 것처럼 선동해 궁핍한 상황을 모면하려 한다"고 지적했다.
'위선 민주주의'는 특권의식에서 비롯된다고 분석했다. 이들은 민주화 운동 참여를 특권으로 여기고 자신들만이 정의라고 생각하며, "여기서 위선까지는 한 걸음도 되지 않는다"고 말했다. 박 시장은 "아리스토텔레스의 말을 빌리자면, 정의의 타락한 형태가 위선"이라며, "입시 비리를 저지르고도 부끄러워하지 않는 모습, 재판을 받지 않게 하기 위해 오히려 재판부와 법을 바꾸려 하려는 뻔뻔한 모습에서 자유민주주의의 도덕적 기반은 내려앉고 있다"고 탄식했다. 그는 "수오지심은 예나 지금이나 정치의 근원적 도덕이 되어야 하는데, 위선은 이를 무너뜨리는 제일 큰 독"이라고 강조했다.
"절제·관용·견제·균형 잃으면 민주주의 아냐"
박 시장은 결론적으로 우리가 바라는 민주주의는 "민주주의의 탈을 쓴 독재, 민주를 가장한 독재일 수는 없다"고 못 박았다. "선거에서 다수를 얻었으면 제멋대로 해도 된다는 다수의 폭력이 올바른 민주주의일 수는 없다"며, "절제와 관용, 견제와 균형의 원칙을 잃는다면 이미 그것은 민주주의가 아니다"라고 경고했다.
마지막으로 "법의 지배가 아닌 법에 의한 지배를 용인하는 순간 자유민주주의는 인민민주주의가 된다"고 비판하며, "대한민국 민주주의는 지금 안녕하지 않습니다"라는 통렬한 메시지를 던졌다.

Mayor Park diagnosed that at a point nearly 40 years since the 87 System, "we are pedaling downhill toward a vulgar democracy, not uphill toward a mature one." He defined this 'vulgar democracy' as "a democracy where those who seize power act arbitrarily in the name of the majority," and strongly criticized that it "is shaking the foundation of South Korea's liberal democratic system by riding on the back of fake democracies such as Armband Democracy, Incitement Democracy, and Hypocritical Democracy."
"Rule by Law, Not the Rule of Law"… 'Armband Democracy' Even Collapses the National Assembly
Mayor Park specifically pointed out that the fundamental principle of democracy, the 'Rule of Law (legality),' is being undermined. He stated, "Armband Democracy is manifesting not as the Rule of Law, the foremost norm of democracy, but as rule by law," and interpreted Chief Justice Cho Hee-dae's remark—that 'King Sejong used the law not as a means of strengthening royal power but as a normative foundation to guarantee the rights of the people'—as "an oblique warning to the ruling power trying to change the Rule of Law to rule by law."
Regarding the current situation in the National Assembly, he declared, "The National Assembly has already collapsed." He pointed out that while the National Assembly Act of South Korea stipulates that the Assembly should be operated through consultation and agreement between negotiating groups, "the Democratic Party is already unilaterally processing all controversial bills," lamenting that the 'tyranny of the majority' has become normalized. He further noted, "The original intent of the National Assembly Advancement Act was to prevent unilateral processing, but it is being abused to unilaterally process all bills," and suggested that most of those bills "will function as a means of governance to strengthen power."
Furthermore, Mayor Park escalated his criticism, saying the current regime is "revealing a black tongue" towards the judiciary, and "even obstructs the appointment of floor leaders, a unique authority of a negotiating group." He lamented, "It's like the Seoul soccer team deciding the captain of the Busan soccer team arbitrarily," concluding that "There is no liberty, no republic, and no democracy."
"Doesn't Bat an Eye at Lies"… Pointing to Moral Decadence of 'Incitement and Hypocritical Democracies'
Mayor Park criticized that the actions of 'Incitement Democracy' are "used without hesitation to bring down the target, regardless of whether it involves distortion, exaggeration, or fake news." He fiercely denounced the behavior of first fabricating non-existent facts to pressure the Chief Justice of the Supreme Court to resign, and then, when the lie was exposed, demanding the Chief Justice "personally undergo the investigation and clear his name," calling it a "truly shameful act to show children."
He focused particularly on the 'lies' that shake the foundation of responsible politics. Questioning the customs negotiation, which was first announced as "so successful that a written agreement isn't necessary," but now is claimed, "signing it would have led to impeachment?" Mayor Park stated, "Responsible politics in a democracy is strictest about lies. However, this regime doesn't bat an eye even when what it says today differs from what it said yesterday." He added that the regime attempts to "escape the dire situation by incitement, as if they defended sovereignty."
Mayor Park analyzed that 'Hypocritical Democracy' stems from a sense of privilege. He said these individuals view their participation in the democratization movement as a type of privilege and believe only they represent justice, asserting, "It's not even a single step from here to hypocrisy." Borrowing the words of Aristotle, Mayor Park stated, "Hypocrisy is the degenerate form of justice," and lamented, "The moral foundation of liberal democracy is collapsing with the shamelessness of those who commit entrance exam corruption without shame, and who try to change the court and the law itself to avoid trial." He emphasized, "The sense of shame (Suojisim) should be the fundamental morality of politics, now as in the past, but hypocrisy is the greatest poison that destroys it."
"If Lost Self-Restraint, Tolerance, Checks, and Balances, It's No Longer Democracy"
Mayor Park concluded definitively that the democracy we desire "cannot be a dictatorship disguised as democracy, or a dictatorship claiming to be democratic." He warned, "The tyranny of the majority—that since they won the majority in the election they can act arbitrarily—cannot be a righteous democracy," adding, "If the principles of self-restraint and tolerance, checks and balances are lost, it is already not democracy."
Finally, he criticized, "The moment rule by law, not the Rule of Law, is condoned, liberal democracy becomes a People's Democracy," delivering the weighty message: "Democracy in South Korea is not well right now."
