더불어민주당과 국민의힘 대통령 후보가 확정됐는데, 사회 일각에서 낙마설이 솔솔 끊임없이 나돌고 있다. 왜 그럴까?
첫째의 낙마설은 검찰 수사 과정 중인 사건과 후보가 관련이 있다는 류(類)이다. 이재명-윤석열 두 후보가 다 문제라는 루머이다.
둘째는 후보의 도덕성 문제이다. 박원순 전 서울시장도 확인되지 않은 성 관련 루머로 죽음으로 도피했었다. 이미 후보로 확정돼 선거운동에 전념하고 있는 A 후보 사생활과 관련한 낙마설 루머가 여전하게 나돌고 있다.
사실이 아닌 루머란 나쁜 것이다. 누구든 가짜 뉴스로 관련자를 소리 없이 죽일 수 있기 때문이다.
사실이 전혀 아닌 루머만으로 상대에게 상처주기식의 선거 수법은 이번 대선의 특징이 돼 버렸다. 혼탁한 선거 양상의 하나이다.
필자는 지난 2013년 2월말 A목사의 ‘박근혜 대통령 관련 루머 동영상 파동’으로 심각한 고통을 직접 겪은 바 있다. A목사는 필자의 이름을 거명하며 “박근혜 의원이 북한을 방문했을 시 거액은 자금을 북한에 전달했다”는 내용의, 사실이 아닌 완전 가짜 이야기를 발설했었다. 필자는 이 사건으로 검찰-재판장에 불려 다녔다. 곤혹스러운 일이었다, 결국 A 목사는 이 동영상 사건과 관련해서 수감생활을 하고 출소했다. 전혀 사실이 아닌 루머였기 때문이었다. 필자는 당시 이 동영상 루머의 희생자였다.
아마 이 루머사건은 국가 최고 지도자를 상대로한 최고의 가짜뉴스 사례였을 것이다. 필자가 당한 루머로 인한 피해는 아주 컸었다. 그런 점에서 루머는 나쁘다. 유머의 유통은 큰 죄악이다.
더불어민주당 '추악한 가짜뉴스' 비난
더불어민주당 공보국의 박찬대 선대위 수석대변인은 지난 11월11일 오후 국회 기자회견장에서 가진 브리핑에서 “선거 방해 위한 악의적인 허위사실 유포를 좌시하지 않겠습니다”고 발표했다. 이 브리핑에서 “이재명 후보 부인 김혜경 여사의 낙상사고에 대한 악의적인 허위사실과 가짜뉴스가 무차별적으로 유포되고 있습니다. 후보 부인의 낙상사고를 왜곡해 삼류 소설에나 실릴 수준의 추악한 가짜뉴스를 만들어 퍼뜨리고 있습니다. 이재명 후보의 이미지를 실추시키고 선거를 방해하기 위한 악의가 곳곳에서 느껴집니다. 더불어민주당은 이 같은 허위사실을 유포한 네티즌 2명을 공직선거법 위반 혐의로 검찰에 고발했습니다”고 전제하고 “근거 없는 가짜뉴스를 생산하여 의혹을 제기하고, 공표하는 행위는 중범죄에 해당합니다. 공직선거법 제250조 제2항에는 ‘당선되지 못하게 할 목적으로 허위사실을 공표하거나 게재한 자’에 대해서는 7년 이하의 징역 또는 5백만 원 이상 3천만 원 이하의 벌금에 처한다고 규정하고 있습니다. 정보통신망법 제70조 제2항 또한 ‘사람을 비방할 목적으로 정보통신망을 통하여 거짓의 사실을 드러내고 다른 사람의 명예를 훼손한 것’에 대해 7년 이하의 징역, 10년 이하의 자격정지 또는 5천만 원 이하의 벌금에 처한다고 명시하고 있습니다”고 알렸다.
이어 “허위사실과 가짜뉴스가 국민의 눈을 흐리고 유권자의 선택을 왜곡시키는 행위를 방치할 수는 없습니다. 또한 후보와 부인의 인권을 지키고, 선거의 신뢰성을 떨어뜨리는 행위에는 단호히 대처할 것입니다. 민주주의를 지키기 위한 노력을 다하겠습니다”고 밝혔다.
