고양특례시가 덕양구 대장동 291-2번지 일원 대곡역 진입도로 토지(명의상 국유지) 35필지 13,340㎡에 대한 소유권이전등기 소송에서 승소하며 약 20억 원(개별공시지가 기준) 상당의 토지를 되찾았다고 밝혔다.
대곡역 진입도로는 2001년~2017년 경의선 용산~문산 복선화 사업으로 만들어졌으며 대장동·내곡동 방향(북쪽)에서 대곡역으로 접근할 수 있는 유일한 도로다.

시는 지난해 6월부터 경의선 복선화 사업 당시 대곡역 진입도로 관련 실시계획승인 및 준공 고시, 협의 서류 등 방대한 자료를 수집·검토했다.
그 결과 대곡역 진입도로 토지의 소유권이 2017년 12월 준공 당시에 확정측량을 거쳐 고양시에 무상귀속 되어야 했다는 점을 확인했다.
사업시행자가 필요한 행정 절차를 이행하지 않은 채 약 6년이 넘도록 대곡역 진입도로 토지의 소유권이 국가에 남아 있다고 판단한 시는 지난해 7월 국유지 관리기관이자 당시 사업시행자였던 국가철도공단에 소유권이전을 요구했다.
그러나 국가철도공단은 준공 관련 선행 절차가 이행되지 않았다는 이유 등으로 소유권 이전을 거부했다.
이에 대해 시는 무상귀속 관련 법률검토를 거쳐 지난해 8월 국가를 상대로 소송을 제기했다.
그리고 올해 1월 청구한 모든 토지의 소유권이 고양특례시에 속한다는 내용으로 의정부지방법원 고양지원의 화해권고결정이 확정됐다.
