현직 대통령의 내란죄 피의자 입건이라는 사상 초유의 사태는 온 국민의 참담함은 물론 대한민국 정부 수립 이후 최대의 국난이다.
국가와 국민을 지켜야 할 대통령이 국가와 국민을 버린 위헌 위법의 만행으로 초유의 사태를 맞은 당혹감은 죄 없는 국민의 몫이지만, 국가의 헌정을 책임지는 위정자들의 자세와 집권여당의 대응은 역사의 이름으로 기억해야 할 실로 엄중한 내용이 넘쳐나고 있다.
내란(內亂)이란 국경을 넘어 발생하는 분쟁이 아닌 외세 개입이 없는 사태로 헌법 제87조에 (대한민국 영토의 전부 또는 일부에서 국가권력을 배제하거나 국헌을 문란하게 할 목적으로 폭동을 일으킨 자)로 규정하고 있다. 이는 동서고금의 역사와 현실에서 어느 나라이든 국법과 형법 중 가장 엄중한 죄다.
도도한 강물과 같은 역사에는 무수한 부흥과 퇴행 그리고 발전과 몰락의 물결이 교훈으로 흘러왔다. 그러나 오늘의 상황은 역사의 교훈을 일일이 열거하고 있을 만큼의 시간적 여유도 없는 절체절명의 위기다.
불과 며칠 전의 내란 사태를 저지하지 못하였다면 어둠의 시대를 한 번도 경험하지 못한 우리의 소중한 아들과 딸들이 겪어야 했을 상황은 광기의 정도에 비추어 실로 참혹하였을 것이다. 나아가 우리 국민은 역사라는 관점에서 위헌과 위법의 시대를 남긴 불명예스러운 부모와 국민이 되었을 것이다.
법을 집행하고 나라를 관리하는 이들에게 국민의 이름으로 묻는다! 내란 수괴 피의자가 신성한 국민을 대표하는 대통령으로 존재할 수 있는가! 자유와 민주의 질서와 준법을 민주 사회 구성원의 의무로 교육받은 나라의 자식들에게 위헌과 위법이 천하에 드러나 국가 내란 피의자로 입건된 순간부터 국가와 국민의 적이다. 아니면 내란 게임의 창시자인가!
오천이백만 국민이 묻는다. 내란죄가 알면서도 모른 척 넘어가도 무관하고 함께 위법의 약속이 가능한 법인가! 나라의 기둥인 어린이와 청소년은 물론 내일의 역군인 젊은이와 국가의 안위를 위하여 나라를 지키는 우리의 자식 군인들에게 법이 법으로 존재하지 않는 작금의 상황과 현실이 있을 수 있는가?
국민은 거듭 묻는다. 국가와 국민의 적인 내란 피의자를 옹호하고 국민이 안중에 없는 방조와 공범적 행위 또한, 국가와 국민의 적이 아닌가! 도대체 누구를 위한 법이며 무엇을 위한 법인가? 위정자들이여! 그대들은 누구를 위한 위정자들이며, 무엇을 위한 위정자들인가!
국가와 국민의 적을 방치하고 있는 믿을 수 없는 위헌 위법의 현실에 나라의 모든 도시와 마을을 막론하고 엄동의 거리에서 외쳐대는 피 토하는 민심은 들리지 않는가!
역사의 이름으로 국민의 주권으로 선언한다. 그릇된 국가권력에 의하여 나라의 근본인 헌법의 중대한 침해를 무참하게 묵살하여 국민의 기본권을 보장받지 못한다면 우리 국민은 민족의 이름으로 역사의 소명으로 더는 미룰 수 없는 자구책을 강구하게 될 것이다. 국민의 권리와 자유를 지키기 위하여 우리의 소중한 아들과 딸들을 보호하기 위하여 최후의 보루인 국민저항권을 행사하지 않을 수 없음을 선언한다.
오늘 오전 집권 여당의 젊은 기수 김상욱 국회의원이 기자회견을 통하여 밝힌 소신과 양심은 나라의 희망이었다. 지난 7일 탄핵소추안 표결에 참석하였던 모습 이후 눈에 띄는 수척한 모습에서 감내해야 했던 고통을 쉽게 살필 수 있었다.
그러나 그는 보수의 진정한 가치는 헌법 질서와 자유민주주의를 수호하는 것이라면서 반헌법적이며 반민주적 행위를 자행한 대통령은 엄단해야 할 국가범죄임을 조목조목 열거하며 즉시 하야를 촉구하였다. 이어 헌정 질서 및 자유민주주의 수호 정신에 따라 깊이 사죄하는 마음으로 탄핵 표결에 찬성할 것임을 선언하였다.
국민의 눈과 귀는 역사의 증인이다. 지난 7일 탄핵소추안 표결에 참석한 합리적 공인의 엄중함을 져버리지 않은 안철수 의원과 시각장애의 어려움 속에서도 국민의 목소리를 간과할 수 없는 국회의원의 책무를 수행하기 위하여 표결 투표에 참여했다는 김예지 의원은 찬반 선택에 앞서 엄중한 역사적 본분의 직무를 비켜서지 않았음을 국민의 눈과 귀는 역사에 증언할 것이다.
나라의 모든 분야 지식인과 지성인에게 고한다. 자유의 나라 민주의 나라가 없는 지식과 지성이 존재할 수 있는가! 법이 법으로 존재하지 못하는 나라에 공정과 원칙이 가능하며 사람다운 삶이 존재할 수 있는가!
