필자는 “나는 정명석을 만나러 간다”는 저자이다. 12월22일, 대전지원에서 JMS 정명석 목사 준 성폭행사건의 1심판결이 내려졌다. 위 책의 저자로서 정 목사의 '중형선고(23년)'가 유감이다.
재판부는 정명석이 스스로를 '재림예수', '메시아'라고 칭하고, 절대적인 지위와 권세를 누리려 한 사실을 확인했다고 판시했다. '재림예수', '메시아'라고 칭(稱)했다는 것을 유죄 증거로 인정한 것이다. 판사는 이 재판의 판결문을 통해, 정명석 목사가 자신을 메시아라고 칭하며, 신도들을 세뇌, 범행을 했다는 이유를 댔다.
이 재판은 21세기, 현실에서 진행된 재판이다. 그런데 '재림예수', '메시아'라는 존재를 과연 누가 인증(認證)할 수 있는 것일까?
이는 절대로 불가하며, 인정하려 애쓸 필요도 없다. “모든 종교는 신이나 하나님이 아닌, 인간이 만들었다”는 관점에서 보면, '재림예수', '메시아'도 인간이 만들어낸 종교 용어임이 분명하다.
예수의 십자가형 처형은 당시 로마법정(빌라도)의 판결이었다. 현대사회는 21세기. 이런 시대에도 종교적 용어로 사법적인 재단(裁斷)을 한다? 정명석, 그가 재림예수인지? 메시아인지? 어떻게 사법부가 증명할 수 있다는 말인가? 종교는 믿음을 전제로 하기 때문에 종교는 종교만의 일이다.
사법부가 왈가왈부할 일이 결코 아니다. 정명석을 '재림예수', '메시아'로, 믿고 안 믿고는 신앙의 차원이다.

2000년 전에 사망했던 예수가 다시 온다는 게 '재림예수'이고, '메시아론'이다. 이를 믿거나 안 믿는 것은 신앙하는 자의 자유의지이다. 사법부가 가려줄 일이 아니다.
이 재판은 세기적인 재판일 수 있다. 정명석 목사. 그는 살인죄를 저지른 범인이 아니다. 올해 78세의 나이인데, 1심 판결대로라면? 앞으로 23년 간 수형생활을 해야 한다면? 101세에나 출감할 수 있다. 그런데도 재판부는 정명석 목사에게 23년 형이라는 중형을 선고했다.
1979년 12.12 군사 쿠데타의 주범(主犯)인 노태우(전 대통령)는 1979년 4월17일, 최종 징역 17년 형(대법 상고기각)이 선고됐다. 국기 문란죄, 즉 군사 쿠데타를 일으킨 범행 때문이다. 그런데 JMS 정명석 목사는 국기 문란죄가 아닌, 사람과 사람끼리의 대인(對人) 범죄인데, 1심에서 23년형이 선고됐다. 너무 과중(過重)한 형량이다.
대법원 양형기준을 초과한 판결이어서, 더 의아하다. 기독교복음선교회(JMS)측이 이 재판의 결과에 불복, 선고 직후-선고기일 법원에 항소장을 제출했다고 한다. '재판 불복'의 성격이 크다. 정명석 피고는 줄곧 무죄를 주장해왔다.
정명석 목사는 1978년에 기독교복음선교회를 창교했다. 그후 세계적인 한국산 종교로 성장했다. 그가 23년 중형을 선고 받았다고 해서 이 교단이 망할리는 없을 것이다. 종교는 탄압을 받으면 더 융성했다. 이게 역사가 보여주는 진리다.
예를들면, 서울시 중구 서소문 공원에는 천주교 현양탑이 있다. 이 탑의 비석에는 한국 천주교가 1784년에 첫 전파됐다고 기록하고 있다. 이 비는 슬픔-고통을 기록하고 있다. 천주교 전래 100년사에 1만명 내외의 순교자가 발생했다는 것이다. 1801년부터 1871년까지 44명이 박해받아 순교(죽임 당함)했다고 한다. 그 시대, 현재의 서소문 공원은 사형장. 반국가 자나 범죄자를 처형하는 형장. 예리한 칼로 목을 쳤다. 이조시대, 그 많은 천주교 신도가 죽임 당함은 인간의 야만성 때문이다. 유교에서 강조하는 제사 등을 거부했다는 등의 이유에서다. 기득권 종교세력이 새로 유입된 종교, 또는 구교가 신교(新敎)의 신자를 죽인 것이다. 그러나 오늘날 한국 가톨릭(천주교)은 한국 핵심 종교의 하나가 됐다. 신앙이란 바로 그런 것이다. 탄압(彈壓)은 곧 성장으로 이어진다.

기독교복음선교회 교인들은 정명석 목사의 중형판결이라는 결과를 보고, 착잡해할 것이다. 이 교단의 공동대표 김대덕 목사의 입장문에서 고뇌가 읽힌다. 이날 김대덕 목사는 “정명석 목사 재판의 판결이 ‘종교와 성범죄’라는 강한 편견에 의해 절차적 정의가 훼손되고 ‘무죄추정주의’와 ‘죄형법정주의’의 헌법적 원칙까지 무시된 결과라는 점에 대하여 깊고 깊은 유감과 우려를 표한다”면서 “재판이 공소의 전제부터 죄형법정주의에 반하는 ‘세뇌와 항거불능’이라는 불명확한 개념의 예단으로 정명석 목사와 선교회를 규정하고 있기에, 더 이상의 공정한 재판을 기대할 수 없는 형편에 이른 선교회 교인들은 거리로 나아가 국민 앞에 공정재판을 호소하기도 했다”고 밝혔다. 이어 “정명석 목사는 어떠한 오해와 핍박 속에서도 하나님을 믿는 신앙인으로서, 진실은 반드시 승리한다는 굳은 신념으로 의로운 싸움을 이어나갈 것”이라며 “본 선교회 또한 정명석 목사와 뜻을 같이하여 성실한 의의 싸움을 함께 할 것이며 결국 정명석 목사의 결백은 하늘과 땅에 분명히 밝혀지게 될 것”이라고 강조했다.
정명석 관련 재판은 종교재판일 가능성이 높다. 향후 2-3심 재판이 기다린다. 무죄추정 원칙이 적용돼야 한다. 2000년 전에도 예수가 하나님이 보낸 구세주가 아니라는 데서, 당시 법정(빌라도)은 예수를 십자가에 처형했다. 한국의 사법부가 그런 반복적인 판결을 왜 하는지 이해가 안 된다. 2000년을 되돌렸다!
[후기(後記)]이 글은 필자 사고(思考)체계의 일단이다. 기독교의 핵심이념인 ‘예수=구세주’ 이론은 인간이 만들었다. 이 이론을 인간들이 2,000년 간 발전시켜 왔다. 이를 기반으로, 새로 온다는 메시아이즘에 따른 메시아가 한국인이라고 주창하는 사람들이 생겨났다. 이는 머리 좋은(IQ=지능지수) 한국인들의 창작품이랄 수 있다. 한국인의 입장에서, 이 이론이 나쁠 리 없다.
신앙세계란 과학으로 증명할 수 있는 영역이 아니다. 예수의 동정(童貞) 잉태는 비자연적이고 비과학적이다. 그럼에도 예수의 동정탄생이론이 2000년 간 존속해왔다. 신앙세계란 이처럼 불가해(不可解)의 세계, 불가해(不可解)의 영역이다.
예수는 인류의 지능 지혜가 미(微) 발달된 년대에 이스라엘에서 태어났다. 그리고 예수 시대, 2천 년 전. 인류의 인구는 얼마나 됐을까? 오늘날은 80억 명의 인류이다. 예수, 그 시대는 아마도 1억 명 내외의 인구가 있었을 것이다. 인구 80억명 시대, 글로벌 시대는 예수 시대보다 ‘사랑’ ‘평화’의 존귀함이 더 중(重)해 졌음직하다. 그러하니 이 시대에 맞는 종교-신앙이론을 제공할 새로운 종교 지도자인 메시아의 출현이 필요할 여지도 있음에 주목해야 한다.
