최상목 대통령 권한대행 경제부총리 겸 기획재정부 장관이 21일 인공지능(AI) 교과서 지위 격하법·TV수신료 통합징수법·국가범죄 시효배제법에 대한 거부권(재의요구권)을 행사했다. 최 권한대행의 4~6번째 거부권 행사 법안이자 윤석열 정부 들어 35~37번째 거부권이다.
최 권한대행은 이날 오전 서울 종로구 정부서울청사에서 열린 제3회 국무회의에서 AI 교과서 지위 격하법(초중등교육법 개정안)·TV수신료 통합징수법(방송법 개정안)·국가범죄 시효배제법(반인권적 국가범죄의 시효 등에 관한 특례법)에 대한 재의요구안을 심의·의결했다.
최 권한대행은 먼저 올 1학기부터 교실에서 쓰일 AI 교과서 지위를 '교육용 자료'로의 격하 내용이 담긴 'AI 교과서 지위 격하법'에 대해 "우리 학생들 교육·미래에 매우 심각한 문제가 우려된다"며 "뭣보다 학생들은 인공지능기술은 물론 앞으로 빅데이터 등 디지털 기술에 기반한 맞춤형 학습을 할 수 있는 교과서 사용 기회 자체를 박탈당하게 된다"고 지적했다.
그러면서 "디지털 기반 교육혁신이란 세계적 추세에도 역행"이라며 "균등한 교육 기회 제공이란 헌법가치를 훼손할 수 있다"고 지적했다.
또 'TV수신료 통합징수법' 관련해선 "수신료 분리 징수 제도는 작년 7월부터 시행돼 이미 1500만 가구에서 분리 납부하고 있다"며 "다시 결합징수하게 된다면 국민들 선택권을 저해하고 소중한 재산권을 침해할 수 있으며 정부는 공영방송이 그 역할을 다할 수 있도록 재정 지원 방안을 적극 검토하겠다"고 했다.
이어 '국가범죄 시효배제법'에 대해 "헌법상 기본원칙 '과잉금지 원칙'에 반하고 민생범죄 대응에 공백이 생길 우려가 크다"고 지적했다. '국가범죄 시효배제법'은 수사기관의 가혹 행위·증거 왜곡 등을 '반인권적 국가 범죄'로 규정하고 이에 대한 공소시효· 해배상 소멸시효를 없앤다는 게 골자다.
더불어 "적법하게 직무를 수행한 공무원 나아가 공무원 유족까지 무기한 민사소송·형사고소·고발에 노출될 우려가 있다"며 "수사 부서 기피 현상이 더욱 심화되며 국가 범죄 대응 역량이 약해지고 그 피해는 고스란히 선량한 국민들께 돌아갈 것"이라고 짚었다.
최 권한대행은 "국회서 통과된 법률안을 거부하는 게 아니며 대안·보안책을 논의해달라는 취지"라며 "오직 국가·국민을 위한 정부 충정을 이해해 주시고 국회의 대승적 협조를 요청드린다"고 국회 측에 주문했다.
이 법안들은 최 권한대행의 재의요구안 결재 시 국회로 되돌아가 재표결 절차를 밟는 가운데 재적의원 과반이 출석해 출석의원 3분의 2 이상(200명)이 찬성해야만 통과된다. 108석을 가진 국민의힘에서 8표 이상 이탈표가 나와야 해 사실상 부결 가능성이 높다.
