브레이크뉴스 정명훈 기자= 국민의힘은 31일 더불어민주당을 향해 "행정부를 통째로 볼모로 잡은 민주당이 마은혁 헌법재판관 후보자 임명을 협박하고 있다"고 비난했다.
박민영 국민의힘 대변인은 이날 논평을 통해 "이진숙 방송통신위원장 직무정지 연장을 목적으로 국회 몫 헌법재판관 추천을 차일피일 미뤄오던 민주당이 이제 와 내란죄까지 불사하며 마은혁 재판관 임명에 사활을 거는 자아분열적 행보를 계속하고 있다"며 이같이 밝혔다.
박 대변인은 "이유는 분명하다. 우리법연구회 행동대장으로 널리 알려진 마은혁 후보자가 민주당을 위해 '묻지마 인용표'를 던져 줄 것이라고 확신하기 때문"이라고 주장했다.
이어 "마 후보자는 '노동자의 최대 적은 미국' 등 반미·사회주의 노선을 기치로 삼았던 '인민노련' 출신이며, 숱한 정치 판결로 논란을 빚었다"고 지적했다.
또한 "민노당 당직자들의 로텐더홀 불법 점거 사건에 대해 '검사가 민노당만 기소한 것은 공소권 남용'이라며 전원 공소 기각, 봐주기 판결을 내렸다가 항소심에서 파기 환송된 바 있다"며 "2009년 서울남부지법 근무 당시에는 노회찬 당시 진보신당 대표의 후원회 모임에 참석해 후원금까지 낸 사실이 알려지면서 논란이 됐다"고 밝혔다.
박 대변인은 "'법복 입은 정치인'인 마 후보자가 재판관이 됐을 때 어떤 선택을 할지는 불을 보듯 뻔한 일"이라고 우려했다.
그는 "마 후보자의 재판관 임명은 절차적으로도 온당치 않다"며 "애초에 국회 몫 재판관 추천이 지연된 이유도 민주당의 몽니 때문이었으며, 여야가 각 1인씩 추천하고 합의로 1인을 정한다는 기존 관례를 깨고 야당이 단독으로 2인을 추천한 것 또한 중대한 하자"라고 지적했다.
아울러 "헌법재판소가 '즉시 임명 효력'에 대한 권한쟁의 청구를 각하하면서 재판관 임명권이 대통령(권한대행)에게 있음을 명확히 했고, 재판관 불임명이 '파면에 이를 정도의 중대한 위헌·위법이 아니다'라는 사실도 분명히 했다"며 "민주당의 즉각 임명 요구는 억지 생떼에 불과하다"고 강하게 비판했다.
박 대변인은 "언론 보도에 따르면 헌재 평의 결과가 5대3 또는 4대4 교착 상태라면 그대로 기각 또는 각하 결정을 내리는 것이 순리"라며 "8대0 인용을 확신한다며 초시계까지 동원해 변론을 서두르더니, 이제 와 6표가 안 모인다며 마 후보자를 밀어 넣고 다시 변론을 재개하겠다는 주장을 펼치는 것 자체가 희대의 촌극이자 최악의 추태"라고 꼬집었다.
그는 "그 따위 애들 소꿉장난만도 못한 결정을 어느 국민이 납득하겠느냐"고 반문하며 "민주당의 광란의 폭주를 중단시킬 수 있는 건 오직 헌법재판소뿐"이라고 강조했다.
박 대변인은 "헌법재판소는 각각 개별 헌법기관인 재판관들의 판단을 있는 그대로 존중해 조속히 결론을 내려야 한다"며 "내란을 자백한 민주당의 집단 광기에 편승해 역사의 죄인이 되는 일은 결코 없어야 할 것"이라고 경고했다.
