찬탄(탄핵 찬성)과 반탄(탄핵 반대)으로 갈라진 보수 진영은 이미 내전 상태다. 이번 대구 합동연설회에서 드러난 민낯은 그 참담한 현실을 고스란히 보여줬다. 늘 그렇듯, 책임은 남 탓이었다. 이는 자승자박(自繩自縛)—제 손으로 만든 줄에 스스로 얽매이는 꼴이다.
윤석열 전 대통령의 계엄령 선포는 헌법이 정한 비상계엄권 발동 요건을 충족하지 않았다. 헌법 제77조 제1항은 '전시·사변 또는 이에 준하는 국가비상사태'에서, '병력으로서 국가의 안녕과 질서를 유지할 필요가 있을 때' 계엄을 선포할 수 있다고 규정한다. 당시 상황은 전시도, 사변도, 국가비상사태도 아니었다. 내란죄 구성요건 또한 충족되지 않았다. 헌법재판소는 이를 명확히 지적하며 전원일치로 탄핵을 인용했고, 윤석열 전 대통령은 대통령직에서 파면됐다. 이렇게 사건은 법적으로 종결됐다.
그럼에도 보수는 거리에서 120일간 소모적인 투쟁을 이어갔다. 결론은 삼척동자도 알 만한 것이었지만, 스스로는 몰랐다. 오히려 계엄령은 이재명의 입법독재 때문이라는 앞뒤 맞지 않는 주장까지 나왔다. 최근에는 '계몽령'이라고 신조어까지 나왔다. 헌법 위반이라는 명백한 사실 앞에서도, 보수는 집단 최면에 걸린 듯 논리를 맹신했다. 이것이야말로 연목구어(緣木求魚)—나무에 올라가 물고기를 구하는 격이다.
탄핵으로 대통령직 파면이라는 징계 절차는 이미 끝났다. 그러나 민주당은 대부분의 진보 정당이 그렇듯이 정치적 선전, 선동의 고수다. 이번에는 형사 절차를 통해 윤석열 전 대통령을 내란죄로 몰아가고 있다. 형법 제87조는 '국토를 참절하거나 국헌을 문란할 목적으로 폭동을 일으킨 자'를 내란죄로 규정한다. 여기서 ‘폭동’이란 다수인이 물리력을 행사하여 국가권력을 불법적으로 장악하거나 헌법기관의 기능을 실질적으로 불능하게 만드는 행위를 말한다. 계엄령 선포가 부당했더라도, 헌법이 정한 절차와 형식에 따라 내려진 명령은 폭동이 아니다. 내란죄 구성요건은 법률가가 아니어도 이해할 수 있을 만큼 엄격하다.
그럼에도 특검은 민주당의 내란 프레임에 보조를 맞추듯 수사에 나섰다. 더 심각한 문제는 보수 스스로다. 찬탄(탄핵 찬성)·반탄(탄핵 반대)의 소모전에 몰두하며, 정작 싸워야 할 내란 프레임의 불법성에는 눈길조차 주지 않는다. 강경보수파는 이미 정치적 생명이 끝난 윤석열 전 대통령을 안고 ‘윤어게인’을 외치고, 중도개혁파는 민주당의 논리를 수용하며 ‘윤석열=내란범’이라는 주장을 반복한다. 당대표와 최고위원 후보들조차 이 프레임을 정치 도구로 삼거나, 반대로 윤석열 전 대통령을 마케팅 수단으로 이용한다.
이번 전당대회는 이 혼란을 적나라하게 드러냈다. ‘윤어게인’을 외치는 한쪽과 ‘내란범 윤석열’을 부르는 다른 쪽. 언론은 민주당의 표현을 여과 없이 받아쓰며 공정보도를 포기했다. 이는 우공이산(愚公移山)처럼 끈질긴 노력이라 할 수도 없고, 오히려 쓸데없는 다다익손(多多益損)—많을수록 더 해로운 어리석음이다.
계엄령 선포가 헌법 위반이었기에 탄핵 인용은 당연히 적법했다. 그러나 내란죄는 전혀 다른 법적 개념이다. 민주당과 특검의 내란죄 주장은 정치적 공세일 뿐, 법률적 근거는 빈약하다. 지금 보수가 싸워야 할 상대는 과거가 아니라, 이 허구적 내란 프레임이다.
그럼에도 보수는 과거의 찬탄(탄핵 찬성)·반탄(탄핵 반대)에 매몰돼 스스로를 소진하고 있다. 보수는 지금 당장 눈을 뜨고 현실을 직시해야 한다. 분열과 무지로는 절대 살아남을 수 없다. 법과 원칙에 기반한 단결과 혁신만이 유일한 살 길이다. 자승자박의 올가미를 즉각 끊어내고, 연목구어 같은 어리석음은 과감히 버려야 한다. 오직 그 길만이 진정한 보수의 미래를 열 것이다. 지금 당장 이 내전의 늪에서 벗어나지 않으면, 멈출 곳 없는 공멸만이 기다릴 뿐이다. 우왕좌왕하며 방향을 잃은 배는 결국 표류한다. 이대로 가면 보수 정당의 미래는 없다. 더 이상 헤매지 말고 정신 차려라! 답은 명확하다. 해체하고 다시 시작하라. 그것만이 살 길이다.

아래 금언이 무지와 분열에 빠진 보수 우파에게 깨우침과 경종이 되길 바란다.

而立矇昧 覺悟則迷途 斷尾求生"
눈먼 자가 코끼리를 보았지만 코끼리의 실체를 모르듯, 계엄령 부당성과 탄핵을 부정하며 현실을 외면하는 자들은 진실을 깨닫지 못한다.
내가 원하지 않는 일을 남에게 하지 말라 했으니, 잘못된 주장을 계속해 당과 국민을 해치지 말아야 한다.

Conservatives in Civil War—From Martial Law to the Frame of Rebellion: 'Self-Destruction Through Ignorance and Chaos'

The bare face revealed at the recent Daegu joint speech clearly revealed this dire reality. As always, blame was placed on others. This is a case of self-imposed entanglement—a self-imposed chain of fate.
Former President Yoon Seok-yeol's declaration of martial law did not meet the constitutional requirements for invoking martial law. Article 77, Paragraph 1 of the Constitution stipulates that martial law may be declared "in times of war, incident, or similar national emergency" when "it is necessary to maintain national peace and order by mobilizing the military." The situation at the time was neither wartime, incident, nor a national emergency. The elements of the crime of rebellion were not met. The Constitutional Court, clearly pointing this out, unanimously upheld the impeachment, and former President Yoon Seok-yeol was removed from office. This legally concluded the case.
Nevertheless, conservatives continued their 120-day, wasteful struggle on the streets. The conclusion was obvious even to a child, but they themselves were unaware of it. Rather, they even made the incoherent claim that martial law was due to Lee Jae-myung's legislative dictatorship. Recently, a new term, "enlightenment law," was coined. Even in the face of the clear fact that the Constitution was violated, conservatives blindly believed the logic, as if under a collective hypnosis. This was akin to climbing a tree to catch fish.
The disciplinary process of impeachment and removal from office has already been completed. However, the Democratic Party, like most progressive parties, is a master of political propaganda and agitation. This time, they are using criminal proceedings to accuse former President Yoon Seok-yeol of sedition. Article 87 of the Criminal Act defines "a person who incites a riot with the intent to usurp the national territory or subvert the Constitution" as guilty of sedition. Here, "riot" refers to an act by a large number of people to illegally seize state power or effectively render constitutional institutions incapable of functioning. Even if the declaration of martial law was unjust, an order issued according to the procedures and formats established by the Constitution does not constitute a riot. The elements of the crime of sedition are so strict that even a non-lawyer can understand them.
Nevertheless, the special prosecutor's investigation appeared to be aligned with the Democratic Party's sedition framing. The more serious problem lies with the conservatives themselves. They are preoccupied with a war of attrition between those in favor of impeachment and those against it, failing to even consider the illegality of the very framing they should be fighting. Hardline conservatives, embracing former President Yoon Seok-yeol, whose political career has already ended, chant "Yoon Again," while moderate reformists, accepting the Democratic Party's logic, repeat the claim that "Yoon Seok-yeol = sedition." Even the party leadership and supreme council candidates exploit this framing as a political tool, or conversely, exploit former President Yoon Seok-yeol as a marketing tool.
This national convention starkly exposed this confusion. One side chanted "Yoon Again," while the other called out "Yoon Seok-yeol, the seditionist." The media has abandoned fair reporting, simply parroting the Democratic Party's rhetoric. This isn't a persistent effort, like the foolish old man moving a mountain. Rather, it's a futile, pointless blunder—the more the better, the more harm.
Since the declaration of martial law was a violation of the Constitution, the impeachment was naturally lawful. However, the crime of rebellion is a completely different legal concept. The Democratic Party and the special prosecutor's claim of rebellion is merely a political attack, with weak legal grounds. The opponent conservatives must now fight is not the past, but this fictitious frame of rebellion.
Nevertheless, conservatives are exhausting themselves, mired in the past's praise (for impeachment) and opposition (against impeachment). Conservatives must immediately open their eyes and face reality. Division and ignorance will never allow them to survive. Unity and innovation based on law and principle are the only path to survival. We must immediately break free from the self-defeating trap and boldly abandon the foolishness of slander. Only then will we open a true future for conservatism. If we do not escape this swamp of civil war immediately, only mutual destruction, with no end in sight, awaits us. A ship floundering and losing its bearings will ultimately drift. If we continue this way, there is no future for the conservative party. Stop wandering and come to your senses! The answer is clear: disband and start anew. That is the only way to survive.
I hope the following proverb will serve as a wake-up call and a warning to the conservative right, mired in ignorance and division.
A blind man sees an elephant, but his vision is unclear.
If you don't want it done to others, don't give it to others.
And when you become enlightened, you will be lost. Cut off your tail and seek life.
Just as a blind man sees an elephant but doesn't know what it is, those who deny the injustice of martial law and the impeachment, while turning a blind eye to reality, are unable to grasp the truth.
I told you not to do to others what you don't want done to you, so don't continue to make false claims and harm the party and the people.
