브레이크뉴스 정명훈 기자= 김건희 여사 특검팀이 통일교가 더불어민주당 정치인들에게 금품을 제공했다는 의혹과 관련 "특검법상 수사 대상이 아니다"라며 이첩할 예정이라고 밝혔다.
민중기 특별검사가 이끄는 특검팀은 8일 정례 브리핑에서 “윤영호 전 통일교 세계본부장의 서명이 포함된 관련 진술을 받아 사건번호를 부여해 기록화했지만, 이는 특검법에 명시된 수사 대상 범주에 포함되지 않는다”며 이같이 말했다.
오정희 특검보는 “윤 전 본부장이 법정에서 한 진술을 변호인 참여 하에 청취했으나, 인적·물적·시간적으로 특검법 제2조에서 규정한 대상 범죄에 해당하지 않는 것으로 판단했다”며 “해당 사건은 일반 수사기관으로 이첩할 예정”이라고 설명했다.
특검팀은 윤 전 본부장의 진술이 특정 정당에만 국한된 내용이 아니었다고 강조하며 “민주당 관련 의혹을 의도적으로 배제했다는 일각의 주장도 사실이 아니다”라고 반박했다.
한편 윤영호 전 본부장은 지난 8월 특검 면담에서 민주당 의원 2명에게 수천만원을 전달했다는 취지의 진술을 한 것으로 알려졌으며 최근 공판에서도 통일교가 다수 정치인에게 접근했다고 증언했다. 이 때문에 특검법 제2조 1항 16호에 따라 ‘관련 범죄행위 인지 시 수사 가능’ 조항이 적용되야 한다는 문제 제기가 있었다.
그러나 특검팀은 “인지된 모든 사건이 특검의 수사 대상이 되는 것은 아니다”라며 기존 판례와 법리를 종합한 결과, 수사 대상에 해당하지 않는다는 입장을 재확인했다. 사건번호를 부여한 것도 이후 다른 기관에서 수사가 진행될 가능성을 대비하기 위한 최소한의 조치라고 덧붙였다.
