브레이크뉴스 정명훈 기자= 도이치모터스 주가조작 의혹과 통일교 금품 수수 의혹 등으로 재판에 넘겨진 김건희 여사가 1심에서 실형을 선고받았다.
윤석열 전 대통령이 공수처 체포 방해 혐의로 징역 5년을 선고받은 데 이어 김 여사까지 실형을 받으면서, 전직 대통령 부부가 동시에 실형을 선고받은 첫 사례가 됐다.
서울중앙지법 형사합의27부(부장판사 우인성)는 28일 김 여사의 자본시장법 위반, 정치자금법 위반, 특정범죄가중처벌 등에 관한 법률 위반(알선수재) 혐의에 대한 선고 공판을 열고 징역 1년8개월을 선고했다. 재판부는 압수된 그라프 목걸이 1개 몰수와 함께 1281만5000원의 추징도 명령했다.
재판부는 통일교 측으로부터 1200만원 상당의 샤넬백과 6000만원 상당의 그라프 다이아몬드 목걸이를 받은 혐의에 대해 알선수재죄를 인정해 유죄로 판단했다. 반면 도이치모터스 주가조작 의혹과 관련한 자본시장법 위반 혐의, 명태균 씨로부터 무상 여론조사를 제공받았다는 정치자금법 위반 혐의에 대해서는 각각 무죄를 선고했다.
재판부는 판결문에서 "영리를 추구하는 것은 인간의 본성이지만 지위가 명리 추구의 수단이 돼서는 안 된다"며 "지위가 높을수록 의식적으로 경계해야 함에도 피고인은 청탁이 결부된 고가의 사치품을 수수하고 자신을 치장하는 데 급급했다"고 지적했다.
김 여사는 선고 과정에서 재판장을 바라보지 않은 채 미동 없이 주문을 들었으며, 실형이 선고되자 고개를 숙인 뒤 변호인과 짧은 대화를 나누고 퇴정했다.
김 여사는 2009~2012년 도이치모터스 주가조작 사건과 관련해 자금을 대는 전주로 참여해 권오수 전 회장 등과 공모하고, 통정거래 등 3700여 차례의 매매 주문을 통해 8억1000만원의 부당이득을 취한 혐의를 받아왔다. 또한 2022년 대선 당시 정치 브로커 명태균 씨로부터 58차례에 걸쳐 2억7000여만원 상당의 여론조사를 무상 제공받고, 같은 해 국회의원 보궐선거에서 김영선 전 국민의힘 의원의 공천에 영향력을 행사했다는 의혹도 제기됐다.
아울러 2022년 4~8월 건진법사 전성배 씨를 통해 통일교 전직 고위 간부로부터 샤넬백 2개와 그라프 다이아몬드 목걸이 등 약 8000만원 상당의 명품을 받고, 통일교 측 현안이었던 '캄보디아 메콩강 부지 공적개발원조(ODA)'와 '유엔 제5사무국 한국 유치' 등을 돕는 대가성 청탁을 받았다는 혐의로 기소됐다.
김건희 특검팀은 결심공판에서 김 여사에게 징역 15년을 구형한 바 있다.
