주낙영 경주시장 예비후보 선거대책위원회는 7일 입장문을 내고 박병훈 예비후보가 전날 기자회견에서 제기한 각종 의혹에 대해 “정책은 실종되고 상대 후보를 헐뜯기 위한 날조와 왜곡으로 점철된 구태 정치”라고 강하게 비판했다.
선대위는 박 후보가 문제 삼은 음성메시지 홍보 활동과 관련해 “선거 현장에서 통상적으로 이뤄지는 실무 과정의 일환”이라며 “해당 사안은 선관위 검토와 신고를 거친 사항으로, 법령에 따라 당당히 소명하고 절차대로 대응할 것”이라고 밝혔다. 이어 “이를 중대 범죄인 것처럼 포장해 정치적으로 악용하려는 시도에는 흔들리지 않겠다”고 덧붙였다.

또 “이 같은 주장은 공직선거법 제250조(허위사실공표죄) 위반에 해당하는 중대한 사안”이라며 “최근 사법부 판례에서도 후보자의 도덕성과 관련된 허위사실 유포에 대해 엄중한 처벌이 내려지고 있다”고 강조했다.
선대위는 실무적 쟁점인 음성메시지 사안과 별개로, 박 후보의 발언을 ‘악의적 허위사실 유포’로 규정하고 즉각적인 법적 대응에 나서겠다는 방침이다. 이날 중으로 경주시 선거관리위원회에 신고하고, 관련 법적 책임을 끝까지 묻겠다고 밝혔다.
선대위는 “폭로라는 가면 뒤에 숨어 시민을 기만하는 행위를 즉각 중단하라”며 “흑색선전은 결코 시민의 심판을 피할 수 없다”고 경고했다.
