경북여심위는 13일 해당 사건과 관련해 A씨를 포항남부경찰서에 고발했다고 밝혔다.
위원회에 따르면 A씨는 지난 3월 25일부터 26일까지 이틀간 자신의 SNS를 통해 포항시장 선거 당내 경선과 관련된 여론조사가 실제로 실시된 것처럼 가장해 공표한 혐의를 받고 있다. 그러나 해당 여론조사는 실제로 진행되지 않은 것으로 확인됐다.
경북여심위 관계자는 “선거 여론조사 결과를 왜곡하거나 허위로 공표하는 행위는 유권자의 올바른 판단을 저해할 수 있는 중대한 위법행위”라고 강조했다.
현행 공직선거법 제96조에 따르면 누구든지 선거에 관한 여론조사 결과를 왜곡해 공표하거나 보도할 수 없으며, 이를 위반할 경우 같은 법 제252조에 따라 5년 이하의 징역 또는 300만 원 이상 2천만 원 이하의 벌금에 처해질 수 있다.
경북여심위는 향후에도 선거 관련 허위 여론조사 공표 행위에 대해 엄정 대응한다는 방침이다.
