법무부에 따르면, 지난 2026년 3월 14일(한국시간) 쉰들러 ISDS 사건에서 정부가 ‘완승’하면서 중재판정부로부터 얻어낸 ‘비용 판정’을 집행하고자, 법무부가 선제적인 변제 요구 (Demand Letter) 등 치밀한 전략을 취한 결과이다.
결국 중재판정 선고 후 한 달 만에 한국 정부의 역대 ISDS 사건 중 최대 규모의 소송비용을 전액 환수하여 국고를 지켜 냈다.
이로써 정부는 최초 청구액 약 4,900억 원, 최종 청구액 약 3,250억 원 상당의 쉰들러 측의 배상청구를 전액 방어하고, 정부의 소송비용까지 전액 환수했다.
