강대식 의원이 병무청으로부터 제출 받은 자료에 따르면 병역신체검사 과정에서 정신질환·안과질환으로 병역 면제 판정을 받고, 정작 해당 질환으로는 취득할 수 없는 자격·면허를 발급받은 인원이 최근 5년간 4,329명에 달하는 것으로 나타났다.
현행 병역법 시행령에 따르면 이와 같은 인원들에 대해 ‘속임수를 썼다고 인정할만한 사유 등’로 보아 확인신체검사를 실시해야 하지만 병무청은 2019년부터 올해 8월까지 단 한건도 실시하지 않은 것으로 확인된다.
특히 이들 중에는 정신질환으로 병역면제판정받고 의료종사자, 어린이집 원장 자격면허 취득한 사례도 있어 논란은 더욱 가중될 것으로 보인다.
이에 대해 강 의원은 “병무청의 직무유기로 밖에 볼 수 없다”고 질타하며 “병역면탈 여부를 확인할 수 있는 확인신체검사를 확대·실시해야 한다”고 확인신체검사의 필요성을 설명했다.
이어 “현재 병무청이 관리하는 정신질환자 취득 제한 자격·면허에는 수렵면허, 주류제조사, 보육교사 등도 있는데도 병무청은 이에 대한 현황 조차 관리하지 않고 있다”며, “정신질환자 등 자격·면허 제한자의 면탈여부와 종합적인 조사·대책이 필요하다”고 강조했다.
