천정배 전 의원은 13일 더불어민주당이 검수완박(검찰 수사권 완전 박탈)을 당론으로 채택하고 4월 국회 내 처리하기로 한 데 대해 이같이 우려를 쏟아냈다.
참여정부 시절 법무부 장관을 지낸 천정배 전 의원은 이날 YTN 라디오 '뉴스킹 박지훈입니다'에서 "검수완박은 범국민적 토론을 거쳐 신중하게 결정해야 한다"며 "입법권은 국회에 있지만 국민들의 의견, 각 계 각 층의 전문가들, 검사들, 경찰, 사법부 등 의견을 다 들어봐야 한다"고 했다.
그는 "민주당은 지난 5년 동안 뭘 하다가 지금 문재인 대통령 임기 1개월 남기고 졸속으로 뭘 하겠다고 하는 것이냐"면서 "윤석열 정부는 무조건 검찰에 우호적인 정권이 될 걸로 보이는데 앞으로 들어올 새 정부는 검찰개혁이나 수사구조 개혁에는 기대할 바가 없다. 국민만 가련하게 됐다"고 꼬집었다.
이어 그는 "장기적으로 생각해보면 과연 경찰은 정치적 중립이 되었느냐 권력남용을 방지할 수 있겠는가 하는 문제는 경찰도 동일하게 해당되는 문제"라며 "그런 문제에 대한 논의나 대책이 별로 없는 것 같다"고 지적했다.
천 전 의원은 "경찰이 갑자기 불과 3~4개월 뒤에 그 엄청난 권한을 이양 받게 되는데 3개월 만에 새로운 수사준비를 할 수 있겠는가"라며 "더구나 지금 시기는 정권교체 시기로, 새로운 대통령이 취임하고 정권이 교체되는 순간인데 그런 준비는 제대로 안 될 것 같다. 아마 수사의 무정부 상태가 될 우려가 있다"고 주장했다.
그는 또한 현직 검사들이 검수완박에 집단 반발하고 있는데 대해서도 "전혀 바람직하지 않다"며 "검사는 공무원이다. 국민의 공복이고 국민에 대한 봉사자로, 그래서 집단행동이 금지되어 있지 않나. 이 문제에 대해 검사들이 변명할 수 있다고 생각하는데 질서 있게 만들어져야 할 거고 그것이 집단행동 수준으로 가면 징계나 처벌 대상"이라고 비판했다.
