[브레이크뉴스=이성용기자] 김상권 교육감 후보 캠프는 중도·보수 단일후보 명칭사용이 허위라며 박종훈 교육감 후보가 제기한 허위사실공표금지가처분 신청이 기각됐다고 19일 밝혔다.
창원지방법원 제21민사부(재판장 권순건)는 지난 12일 박종훈 후보가 김상권 후보를 상대로 중도·보수단일후보 표현사용 금지와 이를 위반할 경우 위반 횟수 1회당 1억원 지급을 제기한 허위사실공표금지가처분 신청에 대해 19일 기각결정을 내렸다.
재판부는 “기록 및 심문 전체의 취지에 의해 소명되는 사정에 비추어 보면 박종훈 후보 측이 주장하는 사정만으로 이 사건 결정에 그 효력을 부정해야 할 만큼 중대한 하자가 있다고 보기 어렵다”고 판시됐다.
재판부는 “박 후보 측의 주장에 따르더라도 김상권 후보의 경력이나 지위 등에 관한 사항으로 박 후보의 명예 등과 같이 민사소송으로 보호되는 자유나 권리 등과 직접적인 관련성이 없다”며 기각 사유를 밝혔다.
또한 재판부는 “이념적으로 어느 진형에 속하더라도 선거과정에서 당선 가능성을 높이기 위하여 중도층의 유권자를 공략하려는 후보자가 대부분인 현실 등을 고려할 때 위 표현만으로 일반 유권자들에게 박 후보가 이념의 편향된 후보라는 인식을 준다는 주장도 이유 없다”고 판시했다.
이에 따라 김상권 후보의 ‘중도·보수단일후보’ 명칭 사용은 아무런 문제가 없게 됐다.
