윤석열 대통령 측 석동현 변호사가 22일 더불어민주당이 자신을 내란 선전 혐의로 고발한 것에 이재명 대표 등을 무고 혐의로 맞고소하겠다고 밝혔다.
수사 변호인단·탄핵심판 대리인단 구성에 관여 중인 석 변호사는 이날 페이스북을 통해 "시민의 한 사람으로서 또 장차 변호인이 될 수도 있는 위치에서 뭐라 말한 걸 내란 선동·선전죄로 몰아 고발한 건 당연히 사실과 다를 뿐 아니라 의도적으로 모함한 것으로 무고죄가 된다"며 이같이 밝혔다.
또 "민주당의 이번 무고성 고발건은 단지 석동현 개인을 억압하겠다는 취지만이 아니라 이번 사태에 대해 내란죄로 볼수 없다는 견해를 가진 많은 법학자·교수·전문가·기타 여론주도층 입에 재갈을 물리고 자유롭게 공개적 의견표시를 하지 못하게 할 의도라 본다"고 지적했다.
그러면서 "내란몰이 정당에서 자기들과 생각 다른 시민을 내란 가담자로 덧씌워 헌법이 보장하는 의사표현 자유를 중대하게 침해·협박하는 처사"라며 "민주당 최고위원 중 누가 주도했는지 알 수 없으므로 대표성 있는 이재명 대표·김윤덕 사무총장을 공범으로 내일(23일) 경찰 국가수사본부에 고소장을 제출 예정"이라고 했다.
민주당은 지난 20일 "내란 행위를 글·기자회견으로 정당화하는 건 명백한 내란선전"이라며 석 변호사를 고발했다고 밝힌 바 있다.
윤 대통령 40년 지기인 석 변호사는 지난 17, 19일 기자들과 만나 "윤 대통령은 체포 '체' 자도 얘기한 적 없다"며 "(내란 혐의는) 전혀 당치 않다"고 밝혔다.
