윤석열 대통령 측이 19일 서울서부지법(부장판사 차은경)의 윤 대통령 구속영장 발부에 "납득하기 힘든 반헌법·반법치주 극치"라고 반발했다.
윤 대통령 변호인단 석동현 변호사는 이날 새벽 올린 페이스북 글에서 "대통령이 헌법에서 부여한 긴급권 행사 일환으로 국민들에게 국가적 비상 위기 실상을 알리고 호소하고자 한 비상계엄 선포행위는 수사기관·법원의 사법적 평가 대상이 될 수 없다는 건 헌법이론 기본"이라며 이같이 밝혔다.
그러면서 "더구나 헌법상 국가 최고 지위에 있는 현직 대통령이 한 일을 형법의 내란범죄로 몰아가는 건 어불성설"이라고 했다.
또 "한편으로 걱정되는 점은 최근 야당·공수처가 탄핵몰이를 하는 것에 반대하는 수많은 국민·재외동포·20대·30대 청년들이 과도한 분노를 표출할까 걱정스럽다"며 "벌써 서부지법 청사 주변에서 일부 조짐이 나타나고 있다"고 했다.
이어 "분노 표출이 충분히 이해는 되지만 도가 지나쳐 폭력 양상이 계속되면 좌파세력 표적 공세·역공작에 휘말릴 수 있다"며 "그것은 윤 대통령이 바라는 바가 아닐 것이고 앞으로 내란죄 프레임 극복·탄핵심판 대처에도 부담될 수 있다"고 우려했다.
더불어 "이럴수록 냉정을 유지하면서 더욱더 정교한 지혜·의지를 모아 위기를 헤쳐 나가야 한다"고 주문했다.
