브레이크뉴스 정명훈 기자= 헌법재판소는 31일 윤석열 대통령 탄핵심판과 관련, 여권에서 재판관들의 개인 성향을 문제 삼는데 대해 "탄핵심판의 본질을 왜곡하고 사법부 권한을 침해할 우려가 있다"고 경고했다.
천재현 헌재 공보관은 이날 정례 브리핑에서 "대통령 탄핵심판은 헌법과 법률 위반 여부를 객관적으로 판단하는 것이지, 재판관 개인 성향에 좌우되지 않는다"며 이같이 밝혔다.
앞서 국민의힘은 문형배 헌재소장 권한대행의 과거 SNS 활동과 특정 재판관 가족의 정치적 연관성을 지적하며 탄핵심판 사건을 회피해야 한다고 주장한 바 있다.
이에 천 공보관은 "회피 요구는 단순한 의혹이 아니라 객관적 사유가 있어야 한다"며 "대통령 탄핵심판의 심리 대상은 피청구인(윤 대통령)의 행위가 헌법이나 법률에 위배되는지와 그 위반의 정도가 중대한 지 여부"라고 강조했다.
또한 윤 대통령 측에서 재판관 기피 신청을 할 가능성이 있다는 언론 보도에 대해선 "현재까지 접수된 문건이 없다"며 "헌재법상 피청구인이 변론에서 진술한 경우 기피 신청을 할 수 없다"고 잘라 말했다.
한편, 헌재는 탄핵심판 관련 증인으로 신원식 국가안보실장, 조태용 국정원장, 백종욱 전 국정원 3차장, 이상민 전 행안부 장관 등을 채택했다.
증인신문 일정을 보면, 신원식 실장과 백종욱 전 3차장에 대한 증인신문은 내달 11일 각각 오후 2시, 오후 3시30분에 진행된다. 조태용 원장에 대한 증인신문은 13일 오전 10시30분에 열린다.
