윤석열 대통령이 25일 헌법재판소 탄핵심판 11차 최종변론에서 "(12·3) 비상계엄은 망국적 위기상황을 선언한 것인데 거대 야당·내란 세력이 국민을 선동하고 있다"고 밝혔다.
윤 대통령은 이날 밤 서울 종로구 헌재 대심판정에서 열린 11차 최종변론 최후 의견 진술에서 "국민께 죄송하고 감사하다"며 이같이 말했다. 현직 대통령의 헌재 탄핵 의견 진술은 헌정 사상 최초다.
그러면서 "지난해 12월 3일 비상계엄 선포 후 84일이 지났다"며 "제 삶에서 가장 힘든 날이었지만 감사와 성찰의 시간이기도 했다"고 말했다.
이어 "그동안 우리 국민께 참 과분한 사랑을 받아왔다는 생각이 들었다"며 "감사한 마음이 들면서도 국민께 일하라고 맡겨주신 시간에 제 일을 하지 못하고 있는 현실이 송구스럽고 가슴 아팠고, 한편으로 많은 국민들께서 여전히 저를 믿어주고 계신 모습에 무거운 책임감도 느꼈다" 전했다.
또 "(비상계엄은) 이 나라가 지금 망국적 위기 상황에 처해있음을 선언하는 것"이라며 "주권자인 국민들께서 상황을 직시하고 이를 극복하는 데 함께 나서 달라는 절박한 호소"라고 했다.
더불어 "무력으로 국민을 억압하는 계엄이 아닌 계엄 형식을 빌린 대국민 호소였다"며 "무엇보다 저 자신 윤석열 개인을 위한 선택은 결코 아니었다는 사실을 분명하게 말씀드릴 수 있다"고 했다.
윤 대통령은 "처으부터 김용현 전 국방장관에 대국민 호소용 계엄임을 밝혔다"며 "2시간짜리 내란이 있나"라고 했다.
그러면서 "거대 야당은 제가 독재하고 집권 연장을 위해 비상계엄을 했다고 주장하고 내란죄를 씌운다"며 "정말 그런 생각이었다면 고작 280명의 실무장도 하지 않은 병력만 투입하도록 했겠냐"고 반문했다.

더불어 "당시 북한이 민노총 간첩단에 '이번 특대형 참사를 계기로 사회 내부에 세월호 참사 진상규명 투쟁과 같은 정세 국면을 조성하는 데 중점을 두고 각계각층 분노를 최대한 분출시켜라'란’지령을 보냈다"며 "거대 야당이 북한 지령을 받은 간첩단과 사실상 똑같은 일을 벌였고, 이야말로 사회 갈등·혼란을 키우는 선동 탄핵"이라고 강조했다.
