최상목 대통령 권한대행 경제부총리 겸 기획재정부 장관이 18일 더불어민주당 등 주도로 국회를 통과한 '방송통신위원회설치운영법(방통위법) 개정안'에 대해 거부권(재의요구권)을 행사했다.
최 권한대행은 이날 오전 서울 종로구 정부서울청사에서 열린 제12회 국무회의에서 "방통위법 개정안은 위헌성이 상당하고 합의제 중앙행정기관으로서 방통위의 안정적 기능 수행을 어렵게 할 우려가 크기 때문에 국회에 재의를 요청한다"고 했다.
지난달 27일 민주당 포함 야당 주도로 국회 본회의를 통과한 방통위법 개정안은 방통위 전체 회의 개의 정족수를 상임위원 3명 이상으로 했다. 현재 방통위 상임위원 정원은 5명이나 국회 몫 3명 추천이 이뤄지지 않은 채 대통령이 지명한 이진숙 방통위원장·김태규 부위원장 2인 체제로 운영 중이다.
최 대행은 "방통위는 방송·통신 정책·국민 보호에 필요한 일상적 행정 업무를 수행한다"며 "개정안과 같이 개의 요건을 엄격하게 적용하면 국회의 위원 추천 없이는 회의를 개회조차 할 수 없게 돼 방통위의 정상 운영이 어려워진다"고 지적했다.
그러면서 "결국 방송사업자 허가·위법 행위 처분·재난 지역 수신료 면제 등 위원회의 기본적 기능을 수행할 수 없게 돼 그 피해가 고스란히 국민·기업에 돌아가게 될 것"이라고 지적했다.
또 "합의제 중앙행정기관 의사 정족수를 전체 위원 과반수 등 엄격하게 법에 명시한 전례 또한 없다"며 "엄격한 개의 요건은 헌법이 정부에 부여한 행정권 중 방송·통신 관련 기능을 국회 몫 위원 추천 여부에 따라 정지시킬 수 있어 헌법상 권력분립 원칙 위반 소지가 크다"고 했다.
더불어 "국회가 추천한 후보를 30일 이내 임명하지 않을 경우 임명된 것으로 간주하는 규정 또한 대통령 임명권을 실질적으로 침해해 권력분립 원칙에 반할 소지가 있다"고 지적했다.
최 대행은 최근 서울 등 일부 지역 주택 가격 상승 관련해선 "부동산 시장에 대해선 국토교통부·금융위원회 등 관계부처가 시장 상황을 철저히 점검해 국민 우려가 확대되지 않도록 필요시 적기에 대응방안을 강구해달라"고 지시했다.
또 국민연금 개혁 논의에 대해 "모처럼 여·야가 연금 개혁에 뜻을 함께 모아 다행스럽게 생각한다"며 "모수 개혁 방안을 조속히 마무리 짓고 근본적 국민연금 지속 가능성 확보를 위한 논의도 본격 시작될 수 있길 기대한다"고 밝혔다.
