윤석열 대통령 변호인단이 31일 "거대 야당 폭정이야말로 대통령이 계엄할 수밖에 없었던 이유를 입증하는 것"이라며 헌법재판소의 조속한 탄핵심판 판결을 촉구했다.
변호인단은 이날 오후 언론 공지에서 "대한민국 자유민주주의·헌정 질서를 지키기 위해 대통령을 하루속히 직무에 복귀시켜 국정을 안정시키고 나라를 제자리로 돌려놓아야 한다"고 강조했다.
그러면서 "(더불어민주당 등 거대 야당의 줄 탄핵이·헌법재판관 임기 변경 입법 등 시도는) 견제·통제도 없는 무한 권력으로 정부 기능을 마비시키고 삼권분립·헌정 질서를 무너뜨리려는 의회 쿠데타·입법 독재에 다름 아니다"고 지적했다.
또 "민주주의의 가장 큰 위협은 '다수 폭정(tyranny of the majority)'"라며 "다수 힘을 앞세워 신속 절대적 방식으로 만능 권력을 휘두르는 것이야말로 법률을 불안정하게 만들고 법의 공정한 집행까지 가로막는 반민주적 악행"이라고 강조했다.
이어 "헌법 제112조는 헌법재판관 임기를 6년으로 규정하고 있는데 거대 야당은 헌법재판소법을 개정해 임기 만료된 헌법재판관 임기를 6개월 연장하려 한다"며 "헌법을 짓밟는 명백히 위헌적 법률임에도 압도적 의석으로 이를 강행 하려 하고 있다"고 지적했다.
더불어 "거대 야당은 자신들 입맛에 맞는 재판관을 즉시 임명하지 않는다는 이유로 대통령 권한대행 재탄핵·국무위원 전원 탄핵까지 주장하고 있다"며 "줄 탄핵으로 정부의 정당한 거부권 행사를 막고 거대 야당이 행정부 역할까지 하겠다는 것"이라고 지적했다.
변호인단은 "심지어 박찬대 민주당 원내대표·김민석 최고위원은 제2 계엄을 들먹이며 탄핵 인용을 협박하고 있다"며 "할 수도 없고 할 필요도 없는 제2 계엄 주장으로 국민을 선동하고 탄핵 인용을 협박하는 이들이야말로 헌정질서를 파괴하는 내란 세력"이라고 지적했다.
그러면서 "일부 언론 역시 음모론에 빠져 왜곡·선동에 앞장서고 있다"며 "장기 비축계획에 의해 준비한 물자를 갖고 비상계엄을 통해 수천 명을 죽이려 했다는 오보를 해놓고도 정정보도조차 하지 않고 있다"고 비판했다.
변호인단은 윤 대통령이 지난 헌재 최종 의견 진술에서 개헌·정치개혁을 마지막 사명으로 생각하며 잔여 임기에 연연않고 87 체제 개선에 최선을 다하겠다는 의사를 밝혔는데도 불구 민주당이 제2 계엄을 막아야 한다는 음모론으로 선전·선동에 나서고 있다고 지적했다.
