브레이크뉴스 정명훈 기자= 내일부터 챗GPT, 제미나이 등 생성형 인공지능(AI)을 통해 제작돼 외부로 유통되는 이미지·영상·음성에는 ‘AI 생성물’임을 알리는 표시가 의무화된다.
과학기술정보통신부는 ‘인공지능 발전과 신뢰 기반 조성 등에 관한 기본법(AI 기본법)’이 22일부터 시행된다고 21일 밝혔다. 해당 법은 유럽연합(EU)에 이어 세계에서 두 번째로 마련된 AI 산업 종합 법안이다.
AI 기본법에 따라 생성형 AI 결과물이 외부로 유통될 경우 이용자가 AI가 만든 콘텐츠임을 인지할 수 있도록 표시하거나 안내해야 하며, 특히 딥페이크 등 실제와 구분이 어려운 생성물은 명확한 고지가 의무화된다.
규제 대상은 AI 제품·서비스를 제공하는 사업자로 한정되며, 일반 이용자는 포함되지 않는다.
다만 법 시행과 동시에 곧바로 제재가 이뤄지지는 않는다. 정부는 최소 1년 이상의 규제 유예 기간을 두고 계도와 지원 위주로 법을 운영할 방침이다.
법 위반 사실이 확인될 경우 과학기술정보통신부는 사실조사와 시정명령을 내릴 수 있다. 이를 이행하지 않을 경우 최대 3000만원의 과태료를 부과할 수 있으나 이는 형사처벌이 아닌 행정벌에 해당한다.
아울러 민원이나 신고가 접수되더라도 즉각 조사에 착수하기보다는 법 적용 여부와 이행 방법을 안내하는 방식으로 운영된다. 이를 위해 과기정통부는 기업의 문의와 애로사항을 해소하기 위한 ‘AI 기본법 지원데스크’를 운영하며, 익명 상담과 비밀 보장 컨설팅도 제공할 예정이다.
