박정희 전 대통령은 10.26 사건 때 김재규 당시 중앙정보부장이 쏜 총탄에 의해 그 자리에서 절명(絶命)했다. 그리고 군사 재판 과정을 거쳐 1980년 5월24일 사형됐다. 김재규의 거사(박정희 제거작전)은 성공했다. 그러나 현행법에 따라 살인자로 체포돼 군사재판을 받고, 사형처리 됐다.
필자는 기록하는 기자(記者)로서 김재규 전 중앙정보부장기 근무했던 중앙정보부, 그리고 김재규 친족-가문과 취재 인연을 맺었었다. 김재규의 친동생 김항규(1929-1997)-여동생 김재선 씨를 비롯 군인 출신 남동생, 김재규의 손위동서인 최세현 박사(심리학) 등과 직접 인터뷰 진행-기록(비록 중앙정보부 전3권의 저자)으로 남길 수 있다.
그뿐 아니라 김재규의 변호인이었던 강신옥 변호사(1936-2021)와 취재(取材)의 인연을 맺었다. 강신옥 변호사는 1979년 10.26 직후 김재규의 변호사로서 그가 사형에 처해질 때가지, 그 과정의 변호(辯護)를 맡았었다. 재판과정에서 일부 기자들은 강신옥 변호사를 만나는 것 자체를 꺼려했다. 정보기관 요원들이 따라 다니면서 방해공작을 펼쳤기 때문이다.

주간신문 기자-편집국장이었던 필자는 그 반대로 강신옥 변호사와의 인터뷰를 여러 차례 진행했다. 인터뷰를 하기로 약정한 어느 날, 강신옥 변호사는 대한노트 한권을 들고 나타났다.
“무슨 노트인가요?”
“아주 중요한 노트입니다”
“무슨 노트인데요?“
강신옥 변호사가 들고 나온 노트는 김재규 접견록이었다, 박정희 대통령을 시해ᄒᅠᆫ 이후 체포돼 감옥에 갇힌 김재규를 접견할 때마다 나눈 대화를 기록으로 남긴 수기(手記=손으로 직접 받아 쓴) 노트였다, 강신옥 변호사는 그 중요한 노트를, 기자인 나에게 빌려줬다. 나는 그 노트를 복사한 이후, 강 변호사에게 돌려줬다.

사형에 처해진 김재규는 최후 진술서(진술 일자=1980년 1월24일)에서 “박정희 대통령은 나 개인에게 있어 사적으로 친형제나 다름없었다. 나는 나의 정분을 야수와 같은 마음으로 끊었다. 나는 처음부터 이 나라의 자유민주주의를 위하여 나의 생명을 독재 체제와 바꾸어야 한다고 생각하고 또 각오하였다"면서 "민주화의 과정에서 희생은 불가피한 것이었고, 그 희생을 줄이는 것이 나의 대의였다. 생명은 고귀한 것이며, 똑같은 것이다. 많은 사람을 희생시키는 것보다는 한 사람의 생명을 희생시킬 수밖에 없었던 것이다"고 주장했다. 그는 박정희 대통령을 살해한 것은 "대통령이 될 야심에서가 아니라 유신의 심장을 쏘았을 뿐"이라고 피력했다. 김재규는 이 문제에 대해 "유신 체제는 그 자체가 꽉 짜여진 억압과 폭력의 조직이었기 때문에 그것을 풀 수 있는 길이 없었다"면서 "자신은 생명을 걸지 않고는 그 누구도 그것을 타파하고 회생시킬 수 없었다"고 고백했다.

김재규의 최후진술은 군사재판임을 감안할 때 강신옥 변호사가 작성했을 것으로 짐작된다. 그 내용은 강신옥 변호사가 김재규의 접견록(接見錄)을 토대로 작성했을 것이다.
