Thirty-one bills for promulgation, including the Public Prosecution Service Act and the Serious Crimes Investigation Agency Act, along with 10 presidential bills and 4 general agenda items, were deliberated and approved at the 11th Cabinet meeting on the 24th.
Accordingly, the Public Prosecutors Office will be abolished on October 2, and a new criminal justice body will be established to handle indictment and the investigation of serious crimes separately.
In accordance with the principle of separation of investigation and indictment, the Public Prosecution Service will lose its investigative function and exclusively handle the filing and maintenance of indictments; it will operate under a three-tiered system consisting of the Public Prosecution Service, Metropolitan Public Prosecution Service, and Local Public Prosecution Service.
With the abolition of the existing prosecution's authority to command and supervise special judicial police officers and the introduction of a new clause prohibiting "abuse of authority," "dismissal" has been explicitly listed as a ground for disciplinary action against prosecutors, allowing for their dismissal without a separate impeachment procedure. The Serious Crimes Investigation Agency (SCA), established under the jurisdiction of the Minister of the Interior and Safety, investigates six major crimes: corruption, economic crimes, defense industry crimes, narcotics crimes, insurrection, foreign exchange crimes, and cyber crimes. Its scope of investigation also includes crimes committed during the tenure of officials, such as those involved in perjury, the Prosecution Service, the police, the Corruption Investigation Office for High-ranking Officials (CIO), and the courts.
Additionally, an amendment to the Act on the Establishment and Operation of Private Educational Institutions and Private Tutoring (Private Educational Institutions Act) has been passed to completely ban "level tests" conducted by private education academies for young children—often referred to as "4-year-old and 7-year-old exams." Under the amendment, founders and operators of private academies are prohibited from conducting tests or evaluations for the purpose of recruitment or level-based placement targeting young children, and violations will result in business suspension or the imposition of administrative fines. The amendment is set to take effect around this coming September, six months after the bill is promulgated.
On this day, amendments to the organizational structure of the Korea Customs Service and its affiliated agencies were also deliberated, including a provision to increase personnel by 450 to block drug smuggling and crack down on the illegal outflow of foreign currency, as well as an amendment to the organizational structure of the Financial Services Commission and its affiliated agencies to increase personnel by 14 to eradicate unfair trading in the capital market.
Among the general agenda items, the Korea-EU Digital Trade Agreement was also approved on this day. It replaces the e-commerce norms of the Korea-EU Free Trade Agreement (FTA) that came into effect in 2011 and aims to establish trade norms for trade via electronic means—such as facilitating e-commerce, protecting online consumers, and cybersecurity—and strengthen the foundation for cooperation in the digital trade sector.
