김완영 행정사, ‘지역주택조합원권리구제협회’ 창립... 조합원 권리구제에 나서

 

[브레이크뉴스 = 김태영 기자] 이재명 대통령이 취임한 이후 지역주택조합의 문제점에 대한 전국 조사를 하였지만, 조합원들의 권리침해에 대한 구제책이 없어 이를 해결하기 위해서는 변호사를 통한 소송이 현실적이지만 소송에 따른 재정 손실과 기간, 사업 추진의  목적 실현 등이 문제점으로 드러나고 있다.

 

이에 김완영 행정사는 "주택법에 의한 조합원의 권리와 계약절차 등에 대해 사전에 정보를 제공하고, 투명한 추진 과정도 법에 의한 정보공개제도를 적극 활용하여 조합원들의 권리를 침해 당하지 않도록 하기 위해 '지역주택조합원권리구제협회'를 창립했다"라는 게 설립 취지에 대한 설명이다.

 

최근 김 행정사는 "조합원의 자격 유무와 관계없이 분양대행사의 안심보장증서를 미끼로 조합가입계약서를 작성한 사례를 접하면서 조합원들의 권리침해가 매우 심하다. 조합 측이나 업무대행사의 횡포에 대한 조합원 권리 구제가 적극적으로 필요하다. 전국 조합원들은 약 26만 명이다"고 말했다.

 

주택법 제2조(정의) 제11호에 의한 “주택조합”이란 많은 수의 구성원이 제15조에 따른 사업계획의 승인을 받아 주택을 마련하기 위하여 결성하는 조합을 말하며, 특히, 지역주택조합은 지역에 거주하는 주민이 주택을 마련하기 위하여 설립한 조합을 뜻한다. 

 

지역주택조합의 제정 목적은 간단하다. 서민들이 스스로 내 집을 마련할 수 있도록 돕는 공동구매 시스템 성격이다. 즉, 이는 서민의 주거 안정 및 내 집 마련 기회 확대, 주택건설 절차의 간소화, 민간 주도의 주택공급 활성화 등을 통해 저렴하게 내집 마련구입이 입법취지이다
