전 대전시장이 언론사를 상대로 제기한 명예훼손 고소 사건에 대해 경찰이 혐의가 없다는 판단을 내렸다.
대전 유성경찰서는 지난달 31일, 출판물에 의한 명예훼손 혐의로 조사받은 지역 내 인터넷 언론과 소속 기자에 대해 '불송치' 결정을 내렸다고 밝혔다.
이 사건의 발단은 지난해 9월 보도한 공공 어린이 재활병원 관련 기사였다.
당시 매체는 전 시장이 재임 시절 공공 어린이 재활병원 건립 과정에서 '국비 지원 포기 각서'가 존재했다는 취지의 내용을 보도했고, 전 시장은 해당 기사에 대한 고소가 했었다.
하지만 경찰은 관련 협약서 내용을 검토한 결과, 국비 지원 계획이 명시되지 않았고 추가 비용을 지방비로 부담한다는 취지가 포함된 점을 확인했고, 이를 바탕으로 기사의 핵심 내용이 객관적 사실과 어긋난다고 보기 어렵다고 판단했다.
경찰은 공적 관심사에 대한 언론 보도의 경우, 설령 일부 과장이나 해석이 가미되더라도 이를 형사 처벌 대상으로 삼기 어렵다는 기존 판례의 취지를 재확인했다.
