박대출 의원은 지역의무 공동계약제도의 근거를 법률로 상향하여 명시하는 내용의 “국가를 당사자로 하는 계약에 관한 법률(이하 ‘국가계약법’)” 일부개정법률안을 대표발의했다고 21일 밝혔다.
지역의무 공동계약제도는 지역 건설업체 지원 및 지역경제의 활성화를 위하여 1994년 도입되었다. 국가 또는 지방자치단체가 공동계약을 체결하는 경우 지역업체 1개 이상을 공동수급체의 구성원으로 하되, 100분의 30 이상의 지분율을 담당하도록 하고 있다.
현행 국가계약법의 경우, 법률이 아닌 시행령에 그 법적 근거와 운영 조건을 규정하고 있다. 시행령에서 지역의무 공동계약에 대해 “가능한 한 공동계약에 의하여야 한다”로 되어 있다보니, 지역업체와 공동 입찰하지 않는 등 실효성이 떨어진다는 지적이 있었다.
이에 박 의원은 건설업 등의 균형발전 및 지역경제 활성화를 위하여 국가를 당사자로 하는 공동계약의 경우 지역업체 1인 이상을 공동수급체로 하는 내용의 국가계약법 개정안을 대표발의했다.
박대출 의원은 “코로나19 장기화로 인해 모두가 힘든 시기지만, 특히나 중소 지역업체는 전호후랑(前虎後狼)의 상황이다”라며, “지역의무 공동계약 제도를 실효성 있게 개정하여 코로나와 경기 침체의 이중고를 겪고 있는 지역업체를 보호할 필요가 있다”고 법 개정 취지를 밝혔다.
