브레이크뉴스 정명훈 기자= 이스타항공 창업주인 이상직 무소속 의원이 '배임·횡령' 혐의로 1심에서 실형을 선고받고 법정구속됐다.
전주지법 11형사부(부장판사 강동원)는 12일 특정경제범죄가중처벌 등에 관한 법률 위반(배임·횡령), 업무상 횡령, 정당법 위반 등 혐의로 기소된 이 의원에 대해 징역 6년을 선고했다.
재판부는 지난해 10월 28일 허가한 보석도 취소해 이 의원은 선고 이후 법정구속됐다.
재판부는 이날 "이스타항공 그룹의 창업자이자 총수의 지위를 이용해 기업을 사유화하고 주식을 저가에 매도해 막대한 이익을 챙기고 주식거래의 공정성을 교란했다"며 "이스타항공을 비롯한 계열사 자산을 불법적인 방법으로 유용해 본인 또는 가족과 친지들이 거액의 경제적 이익을 취하도록 했다"고 밝혔다.
이어 "범행 계획부터 실행까지 모든 과정을 주도하며 관련 임원과 실무자에게 명시적·묵시적으로 지시하거나 보고받는 등 구체적으로 가담했음에도 잘못을 반성하기는 커녕 모든 책임을 부하 직원에게 돌리면서 자신은 검찰의 표적 수사의 희생양이 된 것처럼 변명하고 있다"고 설명했다.
재판부는 또한 "이상직은 범행을 은폐하기 위해 관련 회계자료 등을 인멸하거나 허위 자료를 작출하는 행위까지 일삼았다"면서 "범행 대부분은 사적 이익, 개인 자금 마련을 위한 것이었고, 그로 인한 피해는 고스란히 경영 부실로 이어지고 다시 피해 회사들의 주주, 채권자, 직원 등에게 전가돼 죄책이 매우 무겁다"고 판시했다.
다만 재판부는 공소사실 중 채무 조기 상환으로 인한 범행에 대해선 손해액이 50억원 이상이라고 단정할 수 없어 특경법상 배임죄는 무죄로 판단하고 손해액을 액수 미상으로 보고 업무상 배임죄만 인정했다.
한편 이상직 의원은 2015년 11월 시가 544억원 상당의 이스타항공 그룹 계열사들이 보유한 이스타항공 주식 약 520만주를 그룹 내 특정 계열사에 100억여원에 저가 매도해 계열사들에게 437억원 상당의 손해를 입힌 혐의를 받고 있다.
2016년부터 2018년까지 이스타항공 그룹 계열사 채권 가치를 임의로 상향하거나 하향 평가하고 채무를 조기에 상환하는 방법 등으로 계열사에 56억원 상당의 손해를 끼친 혐의도 있다.
또한 2013년부터 2019년까지 이스타항공과 계열사의 돈 59억여원을 빼돌려 개인 생활비로 쓰거나 딸 포르쉐 차량 구입, 딸 오피스텔 임대료 등으로 사적 사용한 혐의도 받고 있다. 이 의원이 유용한 59억여원 중 개인 변호사 비용과 정치자금 등의 용도로 38억여원을 사용한 것으로 검찰은 보고 있다.
이상직 의원은 이번 재판과 별개로 제21대 국회의원 총선 과정에서 당원 등에게 불법으로 지지 호소 문자메시지를 대량으로 보낸 혐의로도 기소돼 1심에서 징역 1년 4개월에 집행유예 2년을 선고받은 바 있다.
