브레이크뉴스 정명훈 기자= 허경영 국가혁명당 대선 후보가 3일 원내 4개 정당 대선후보만 참여하는 생방송 TV토론은 불공정하다며 법원에 방송금지가처분 신청을 다시 제출했다. 허 후보는 앞서 같은 내용의 가처분 신청을 냈으나 기각된 바 있다.
허경영 후보는 이날 오전 11시 서울 마포구 서울서부지법을 찾아 방송금지 가처분 신청서를 제출하면서 "날 상대하는 게 그렇게 자신이 없나. 내가 TV에 나가면 다 떨어질까봐 무서운 건가"라고 밝혔다.
그는 "언론사들이 날 여론조사에 포함시키지도 않는데 내 지지율이 5%를 넘지 못하는지 어떻게 아느냐"면서 "법원이 가처분신청을 또 다시 받아들이지 않으면 어떤 투쟁도 불사하겠다. 방송사도 전국민에게 엄청난 비난을 받게 될 것"이라고 목소리 높였다.
이어 그는 "내가 TV에 못 나오게 원천 차단하는 건 여야 대선 후보가 자신이 없어 그러는 것"이라며 "허경영, 진짜배기가 나타나면 짝퉁들이 꼼짝없이 떨어지는 게 두려운 것"이라고 주장했다.
앞서 서울서부지법은 지난달 28일 허 후보가 낸 가처분 신청에 대해 국가혁명당이 국회에 의석이 없다는 점과 여론조사 지지율에서 평균 5%에 미치지 못하는 점 등을 이유로 들며 기각 처분을 내렸다.
당시 법원은 "유권자에게 유용한 정보를 제공하고 토론과 대담을 활성화하기 위한 합리적이고 상당한 차별"이라며 "평등의 원칙이나 국민의 알 권리, 선거권이나 정당성, 공정성을 침해해 토론회 참석 대상자 선정에 대한 언론기관의 재량을 일탈한 것이라고 보기 어렵다"고 판단했다.
한편, 이번 가처분 신청도 앞선 신청을 기각한 민사합의21부에 배당됐다. 재신청을 하면 이르면 당일에도 심리기일이 잡히긴 하나, 실제로 이날 오후 중으로 잡힐 가능성은 낮아 보인다.
