권성동, 민주당 '행정입법권' 통제 추진에 "반헌법적" 비판

윤석열 대통령도 우려 "시행령 수정 요구는 위헌소지 많아"

브레이크뉴스 정명훈 기자= 권성동 국민의힘 원내대표는 13일 더불어민주당이 행정입법권을 통제하는 내용의 국회법 개정안을 추진하는데 대해 "반헌법적"이라고 맹비판했다.

 

권성동 원내대표는 이날 국회에서 열린 최고위원회의에서 "민주당이 최근 제출한, 행정입법권을 통제하는 내용의 국회법 개정안은 예산편성권을 국회로 가져온다는 주장만큼 반헌법적이다. 3권분립 정신을 무너뜨리겠다는 것"이라며 밝혔다.

 

그는 "민주당은 문재인 정권 5년간 행정부를 견제, 감시하기는 커녕 국회를 청와대 출장소로 전락시켰다"면서 "이젠 야당이 되자마자 행정부를 통제하기 위한 모든 수단을 강구하고 있다"고 주장했다.

 

이어 "지난 대선 당시 '소수정당 식물 대통령'을 운운했듯이 거대의석으로 사사건건 새 정부의 발목을 잡겠다는 다수당의 폭거"라며 "민주당이 대선에서 패배하자 후반기 법사위원장을 국민의힘이 맡기로 한 여야 합의를 뒤엎은 이유도 다르지 않을 것"이라고 지적했다.

 

그러면서 "당리당략에 따라 헌법파괴를 서슴지 않는 지금의 민주당이 국회의장과 법사위원장을 모두 독식한다면 헌법파괴 입법독재를 막을 방법이 없다. 임대차3법이 그러했듯 입법권 남용의 피해는 다수 국민에게 돌아갈 것"이라고 덧붙였다.

 

이와 관련 윤석열 대통령도 우려를 나타냈다.

 

윤석열 대통령은 이날 용산 대통령실 청사 출근길에 기자들과 만나 "어떤 법률안인지 한번 봐야하지만, 언론에 나온 것처럼 시행령에 대해 수정 요구를 가진다는 것은 위헌소지가 많다고 본다"며 "시행령 내용이 법률의 취지를 위반한다면, 법률을 구체화한다거나 개정해서 시행령을 무효화할 수 있지 않느냐. 그런 방식이면 모르겠지만, 시행령은 대통령이 정하는 것이고 헌법에 정해져 있는 절차와 방식대로 하면 된다고 생각한다"고 말했다.

 

한편 조응천 민주당 의원은 정부가 대통령령 등 시행령을 통해 국회를 우회하는 것을 막기 위해 국회가 시행령 및 시행규칙의 수정 또는 변경을 요청할 수 있는 내용을 담은 국회법 개정안을 대표발의할 예정이다. 민주당은 이 개정안을 당론으로 추진해 국회 본회의를 통과시킬 계획이다.
