충남도의회가 교육공무원 직무관련 사건 소송비용 지원을 추진한다.
적극행정 활성화를 위해 공무원 직무관련 사건 소송비용 지원체계 마련에 나선 충남도의회는 이를 위해 홍성현 의원(천안1·국민의힘)이 대표 발의한 ‘충청남도교육감 소속 공무원 등의 직무관련 사건에 대한 소송비용 지원 조례안’을 예고했다고 31일 밝혔다.
홍 의원이 발의한 조례안에 따르면 공무원이 정당한 직무수행 과정에서 수사를 받거나 기소 또는 피소된 경우 해당 공무원에게 심급별 1000만 원의 범위에서 변호사 수임비용, 송달료, 인지대 등 직무관련 소송비 지원을 할 수 있도록 했다.
해당 조례안은 또 소송비용을 지원받은 공무원은 심급이 끝날 때마다 수사 또는 소송 진행 상황과 결과를 교육감에게 보고하도록 했다.
단, 공무원에게 고의 또는 중대한 과실이 인정되어 패소로 확정, 유죄로 판결이 확정된 형사사건이나 허위 또는 부정한 방법으로 소송비용 지원을 신청한 경우에는 전액을 회수하는 내용을 담고 있다.
조례안을 발의한 홍성현 의원은 “정당한 직무수행 과정에서 피소된 경우 소송비를 지원함으로써, 공무원들이 위축되지 않고 적극적으로 행정력을 발휘할 수 있게 되길 기대한다”고 말했다.
