김영삼 정권은 '역사 바로세우기 정책'을 구사, 12.12 군사 쿠데타를 일으켰던 주범인 전두환-노태우, 두 전 대통령을 구속 수감시켰다. 재판부는 노태우에게 17년 형을 선고했다. 그런데 준(準)강간 혐의로 구속된 기독교복음선교회(세칭 JMS)의 정명석 목사에 대해, 재판-1심(대전지원)에서 23년형 판결이라는 과다한 중형이 선고(2023년 12월 22일) 됐다. 아주 무시무시한 형량의 판결이다. 그러하니, 고법에 항소된 이 사건에 관심이 쏠리게 돼 있다.

지난 3월5일 오후 항소심 1차 공판이 대전지법 고등법원 제3형사부 심리로 진행됐다. 항소심 첫 공판의 심리-항소이유 설명에서 드러난 바로는, 검찰은 기독교복음선교회(JMS) 정명석 목사를 신흥종교 교주로 인식한 듯하다.
이 심리에서 '세뇌(洗腦)'가 등장했다. 정명석 목사 측 변호인단은 판사 앞에 선 변론(辯論)에서 '세뇌(洗腦)'와 '항거불능(抗拒不能)' 문제를 꺼냈다.
피고(정명석)측 변호사는 이 문제의 설명에 긴 시간을 허비했다. 항소심 첫 심리에서 나온 피고측 변호사는 “피고인은 1심 심리 전에 이미 종교적 권위 이용한 추행범으로 낙인찍혔다. 원심도 무죄추정원칙 했는지 대한 의문이다. 피고인측 주장에 대해 법리 사실을 막연히 인정, 사실요인 위법이다. 자유 심증주의 위반이다. 대법원의 양형기준마저 위반한 양형 부당으로 위법”이라고 주장했다.
이어 “언론의 부정적 영향을 많이 받았다. 고소인 기자회견, 넷플릭스 방영 이후 3개월 간 1만 건 이상의 부정적 보도 있었다. 법원 판결에 영향 주었다고 생각한다. 특히 고소를 주도한 A씨는 정명석 목사가 1만명을 성폭행 했다고 근거 없는 허위 주장을 했다. 과연 선교회 신도가 3만명에 불과한데 1만명 성폭행이 가능한가? 사실 검증 없는 허위 보도가 만연했다”고 강조했다.
피고(정명석)측 변호사는 “검찰의 공소장 내용은 세뇌로 인한 항거불능이라 한다. 피고인이 재림예수 혹은 메시아란 전제조건을 달았다. 성적 신체접촉 행위는 신랑의 신부에 대한 사랑의 표시라서 피고인의 말을 거역하면 암에 걸리거나 지옥에 간다고 공포감 심어주었다고 했다. 이로 인해 고소인들이 모두가 항거불능 상태로 빠졌다는 것이다. 그러나 위 공소사실은 어느 하나 증명된 게 없다. 피고인 행위를 용인할 것인지 생각한다는 것은 피고인의 어떠한 행동도 거부해선 안 되는 세뇌(洗腦)와 일치하지 않는다”고 설명하고 “피고인 행위가 성적 행위인 걸 알면서 혼란이 가중된 상태를 항거불능으로 볼 수 없다. 심신상실이 될 정도의 항거불능이라 보기에 어렵다. 원심(1심)의 주장처럼 선교회 교리에는 성적 접촉을 용인하는 내용이 없다. 교리에 성적 접촉을 용인하는 내용도 없다. 또한 예배 시 설교를 통해서도 피고인의 신격화 과정이 없었다. 절대적 권위, 절대자라고 한 적 없다. 피고인은 '난 절대 신이 아니다, 사람이다, 줄반장이다'라고 했다. 메시아 구세주는 예수님만이 할 수 있다고 했다. 피고인은 '인간일 뿐, 신이나 예수님 같은 존재 아니다'고 했다. 그럼에도 검찰은 피고인이 재림예수 성자(聖子)의 분체 같은 절대적 지위라고 주장했다. 원심은 예배당 및 수련원이 성적인 것을 받아들이라고 한다는데, 월명동(JMS 자연교회) 내에 피고인을 형상화한 물건은 거의 없다. 4미터 높이 예수상만 있다. 만일 피고인이 재림예수면 왜 이걸 두겠나? 1심에서 현장검증 강력히 요청했는데도 원심 법원이 거부하고 자의적 판단한 것”이라고, 변론했다.

변호사는 피고인 정명석 목사가 교인들을 상대로 세뇌를 했거나, 항거불능 상태에 빠뜨리지 않았음을 주장했다. “월명동 자연교회에 안에 4m 높이의 예수상만 있다”고 설명했다.
