대통령실이 24일 체코 신규 원전 수주 우선협상대상자로 선정된 한국수력원자력과 미국 웨스팅하우스간 지식재산권 소송전 분쟁에 "정부는 양국 원전 기업 간 분쟁의 원만한 해소를 위해 여러 경로를 통해 미국 정부와 논의를 진행 중"이라고 밝혔다.
대통령실 관계자는 이날 "향후 체코 원전 수출에 차질없도록 굳건한 한·미 동맹 기조하에 미국 측과 지속 긴밀히 협의해 나갈 예정"이라며 이같이 말했다.
그러면서 "한·미 양국 정부 간엔 원전 포함 재생·수소 등 에너지 전반에 관해 협력 필요성이 크다는 점에 공감대를 형성하고 있다"고 덧붙였다.
한국수력원자력·두산에너빌리티·대우건설 등 한국 기업들은 지난달 체코 원전 수주전에서 우선협상대상자로 선정됐으나 경쟁했던 웨스팅하우스는 지난 2월 일찌감치 탈락했다.
그러나 웨스팅하우스는 지난 2022년 10월 한국형 원전이 미국 원자력에너지법에 따른 수출통제 대상인 웨스팅하우스 기술 활용을 주장하며 미 정부 허가 없이 수출하지 못하게 해달라는 소송을 미 법원에 제기했다.
이에 한수원은 웨스팅하우스가 문제 삼은 원자력에너지법은 법을 이행할 권한을 미 법무부 장관에게 배타적으로 위임했고, 사인에겐 소송을 통해 권리를 주장할 권한을 부여하지 않았다며 맞섰다.
지난해 9월 미 워싱턴DC 연방지방법원은 한수원 주장을 받아들여 웨스팅하우스가 제기한 소송을 각하했으나 웨스팅하우스는 이에 불복해 지난해 10월 워싱턴DC 연방항소법원에 항소장을 제출했다.
한편 오는 9월 윤석열 대통령의 체코 방문에 이재용 삼성전자 회장·최태원 SK그룹 회장·정의선 현대차그룹 회장·구광모 LG그룹 회장 등 4대 그룹 총수가 포함된 경제사절단이 동행할 것이란 전망 관련해선 "주관단체(대한상의)에서 모집·선정하는 것으로 현재 체코 경제사절단을 주관하는 대한상의에서 선정 절차가 진행 중"이라고 밝혔다.

In response, KHNP argued that the Atomic Energy Act, which Westinghouse took issue with, exclusively delegated the authority to enforce the law to the US Attorney General and did not grant private individuals the authority to assert their rights through lawsuits.
