나는 올해로, 기자생활 51년째이다. 비교적 어린 시절에 주간신문사의 편집국장-발행인 자리에 올랐었다. 그런 연유로, 여러 가지 법적인 방패막이가 됐다. 기사로 문제가 생길 때마다 편집국장이나 발행인이, 기사-글 문제로 인한, 형사-민사 사건 고소(告訴)의 대상이 됐었다.
미국 뉴욕의 맨해튼에서 기자생활을 할 때(1980년대 후반), 미 연방 법원에 고소된 적이 있었다. 한국 정부가 발표한 간첩단 사건을 기사화 했는데, 이 사건에 연루된 미국 시민권자가 사실이 아니라고 나를 고소한 사건이었다. 미국의 법정에도 섰었다.
나는 치열한 반정부 기자-폭로성 기사를 쓰는 기자로, 젊은 시절을 보냈었다.
한국에서는 비교적 오랜 기간, 신문사의 편집국장-발행인 자리에서 일해 왔다. 이 때문에, 여러 가지 사건이 발생할 때마다, 법적으로 방패막이 역할을 해야만 했다. 기사로 문제가 생길 때마다 편집국장이나 발행인이, 기사-글 문제로 인한, 형사-민사 사건 고소(告訴)의 대상이 됐기 때문이다.

세계 어느 나라이든 명예훼손법이 있다. 미국이나 일본 등 선진국들에는 민사(民事) 사건에만 이 법이 있다. 그런데 후진국인 우리나라는 민사-형사에 이 법이 살아 있다. 기사가 문제가 되면 기자나 신문사 관련자들을 투옥 시킨다. 그러하니 허 구 헌 날 경찰-검찰에 불려 다니고, 재판정에 나가야 했다.

나는 1997년에 신문사(펜 그리고 자유)를 창간했다. 그해 어느 날 새벽, 검찰 수사관들에 의해 대검 중수부에 끌려갔었다. 신문사 발행인을 영장도 없이 납치하듯 끌고 갔다. 왜 끌려갔는지, 아직도, 잘 모른다? 거액의 신문사 설립 자금을 김대중(당시는 민주투사=전 대통령)이 지원했지 않았느냐는 것 때문이었으리라. 그것은 전혀 사실이 아니었다. 아무 일 없이, 나가라 해서 내 발로 검찰청을 걸어 나왔다.
나는 기자생활을 하는 중에, 기사와 관련해서, 이런 저런 사건으로 수많은 소송에 휘말렸었다. 그런데, 모두 무혐의 처분을 받았다. 다만, 선거법 위반 사건(2004년)으로 10여 일, 투옥 당(이명박 정권에서 사면 복권 됨)하기도 했다.
박근혜 정권 출범 3일 후(2013년 2월), 조웅 목사 동영상 사건(북한 김정일 관련 발언)이란 이상한 사건에 연루돼, 재판장에 불려 다니는 등, 고난을 경험하기도 했었다.
나는 2024년 10월15일 오전에도 서울 중앙지방법원 516호 법정에 다녀왔다. 민사 소송 1심 재판(손해배상 사건 피고임. 문혁 판사) 때문이었다. 기사와 관련한, 거액의 손해배상을 요구하는 소송에 관한 판결이 있었으나, 판결된 손해배상액이 아주 작았다. 99.3% 승소한, 재판이랄 수 있다.
나는 그간, 수시로 경찰서-검찰-법정을 오가긴 했지만, 크게 곤욕을 당하지는 않았다.
명리학(命理學) 용어에 일장당관(一將當關)이란 용어가 있다. 풀이하면 “장수 한 명이 나타나 다 쓸어버리다”는 뜻이다.

고백한다면, 기자인 나를 그동안 지켜주었던 한 가지 중요한 가치가 있다. “사실(事實)의 가치(價値)는 진실(眞實)과 동격(同格)”이라는 것이다. 내가 수많은 사건과 연루되어 경찰-검찰의 수사와 재판부가 진행하는 재판에 응했었지만, 그런 사건 모두에서 승리(勝利)한 것은, 기자로서 오로지 사실(事實)에 충실(充實)했기 때문이었다.
나의 수호신은 일장당관(一將當關)이 아니라, 사실(事實)이었다. 사실이란, 기자에게 있어 목숨과 같은 것이다.

This is my 51st year as a reporter. I became the editor-in-chief and publisher of a weekly newspaper at a relatively young age. For that reason, I had various legal shields.
