한국부동산원이 공사비 분쟁·갈등 해법을 찾기 위해 워크숍을 열었다.
한국부동산원(원장 손태락)은 공사비 분쟁 조정 전문가를 대상으로 ‘공사비 분쟁 정비구역 파견 전문가 워크숍’을 개최했다고 11월 8일 밝혔다.
국토교통부와 함께 진행한 이번 워크숍은 서울 중구 청파로 LW컨벤션센터에서 진행됐다. 이날 행사는 지난해 10월 도입된 ‘공사비 분쟁 정비구역 전문가 파견제도’ 활성화를 통해 공사비 분쟁·갈등 해소를 지원하고자 개최되었다. 지난 9월 한국부동산원 공모를 통해 위촉된 정비사업 분야별 전문가들(건설, 법률, 회계, 정비)이 참석했으며, 이들은 향후 중재단 구성이 어려운 지자체에 파견될 예정이다.
이번 워크숍은 국토교통부의 재개발·재건축 정책 방향, 한국부동산원의 정비사업 분쟁·갈등 지원 방향에 대한 설명으로 시작했다. 특히, 국토부는 전문가 파견을 확대하기 위해 8·8대책 후속 조치로 발의된 '재건축·재개발사업 촉진에 관한 특례법' 개정을 통한 법적 근거 마련에 노력하고 있다고 밝혔다.
김남성 한국부동산원 산업지원본부장은 “공사비 분쟁이 사업 지연뿐만 아니라 조합원 재산권에 영향을 주는 만큼, 사전 예방 및 신속한 해결을 위해 최선을 다해 지원할 것”이라며 “제도 활성화를 위해 전문가 구성 및 역량 강화에 대한 지원을 아끼지 않겠다”고 말했다.
이어 최근 문제가 되고 있는 공사비 증액 계약 관련 물가변동 배제 특약의 효력 등 관련 판례 해석, 정비사업 표준계약서 해설, 사례 중심의 중재를 통한 분쟁 해결 방법에 대해 설명했다.
한편 한국부동산원은 이번 워크숍에 이어 11월 13일 영남·호남 지역 전문가를 대상으로 대구에서 2차 워크숍을 진행할 예정이며, 이후에도 지속적으로 전문가들과 교류하고 관계기관들과 소통하는 기회를 마련할 것이라고 밝혔다.

Korea Real Estate Institute held a workshop to find solutions to construction cost disputes and conflicts.
On November 8, Korea Real Estate Agency (KRA) announced that it held a workshop for experts in construction cost dispute mediation.
The workshop, held in conjunction with the Ministry of Land, Infrastructure, and Transport, was held at the LW Convention Center in Cheongpa-ro, Jung-gu, Seoul. The event was held to support the resolution of construction cost disputes and conflicts through the activation of the 'Dispatching Expert System for Construction Cost Dispute Maintenance Zones' introduced in October last year. Experts in the field of maintenance projects (construction, law, accounting, and maintenance), who were appointed through a competition held by the Korea Real Estate Agency in September, attended the workshop and will be dispatched to local governments where it is difficult to organize arbitration.
The workshop began with an explanation of the MOLIT's redevelopment and reconstruction policy direction, as well as the direction of MOLIT's support for disputes and conflicts in maintenance projects. In particular, the MOLIT said that it is working to establish a legal basis through the revision of the 'Special Act on Promotion of Reconstruction and Redevelopment Projects,' which was proposed as a follow-up to the 8-8 Plan, to expand the dispatch of experts.
“As construction cost disputes affect not only project delays but also members' property rights, we will do our best to prevent and quickly resolve them,” said Kim Nam-sung, head of the Industrial Support Division at the Korea Real Estate Agency.
He explained the interpretation of relevant case law, such as the effectiveness of price change exclusion clauses related to construction cost increase contracts, which have recently become a problem, the explanation of standard contracts for maintenance projects, and how to resolve disputes through case-based mediation.
Meanwhile, following this workshop, the Korea Real Estate Institute will hold a second workshop in Daegu on November 13 for experts in the Yeongnam and Honam regions, and will continue to provide opportunities for exchanges with experts and communication with related organizations.
