윤석열 대통령 헌재 탄핵심판 대리인단이 27일 "(윤석열) 대통령이 적절한 시기에 탄핵심판에 직접 나와 발언할 것"이라고 밝혔다.
윤 대통령 측 대리인 윤갑근 변호사는 이날 오후 서울 종로구 헌법재판소에서 열린 탄핵심판 첫 변론준비기일을 마친 후 이같이 전했다.
그러면서 이날 오전 대리인단이 구성된 부분 관련해선 "변호인단이 속속 합류 예정이고 지원하는 사람도 많아 곧 완성 예정"이라며 "갑작스럽게 대리인단을 공개한 이유가 있진 않고 헌재 절차에 당당하게 대응하려 했던 것이기에 준비했던 대로 진행하고 있다"고 전했다.
또 "오늘은 그야말로 준비 기일로 송달이 적법하게 되지 않은 상태서 다 준비하지 못하고 나와 다음 기일에 자세하게 대응토록 하겠다"며 "지금 송달이 형사소송법·민사소송 규정 등을 아무리 검토해 봐도 적법하게 됐다 해석할 여지가 전혀 없다"고 지적했다.
고위공직자범죄수사처(공수처)의 3차 소환 요구에 대해선 "헌법 재판이 선행돼야 하지 않을까 생각한다"며 "수사 문제는 수사기관이 중복 소환한 문제가 있고 수사권이 어느 기관에 있느냐 하는 문제도 해석 여지가 많았다"고 했다.
이어 "여러 문제점이 너무 많아 종합 검토한 후 대응 방안을 강구할까 생각한다"며 "공수처에 과연 수사권이 있느냐는 문제 등 여러 문제를 검토 후 말씀드리겠다"고 덧붙였다.
한편 윤 변호사는 이날 탄핵심판 사건 첫 번째 변론준비기일에서 "헌재 계류 중인 탄핵 사건들이 많이 있는데 이 사건을 제일 먼저 심리하고 빨리 진행하고 촉박하게 진행하는 재판장들 협의·근거가 있었느냐"며 "물론 이 사건이 가장 국민에 중요하고 빨리 끝내야 하는 부분이 있긴 하나 변호인들이 형사·탄핵사건을 같이 진행해 충분한 인력이 확보되지 않았다"고 했다.
또 "소송 지연을 하려는 건 아닌 변호인단 숫자가 너무 적다"며 "기일을 너무 빨리 잡고 하면 정리하는 데 시간이 필요하기에 기일을 고려해 잡아달라는 취지였다"고 했다.
정형식 헌법재판관은 "이 사건이 가장 시급하고 빨리 해야 되는 사건부터 하는 거라 회의서 결정한 것"이라며 "탄핵 심판은 형사 소송에서 피고인 권리를 보호하는 것과 다르고 헌법 질서를 유지하는 게 제일 큰 목표"라고 했다.
이어 "어느 면에선 형사 소송에서 피고인처럼 엄밀하게 증거를 따지고 개인적 권리 보호를 형사소송만큼 보장해 드리기 어렵다"며 "그렇다고 일방적 진행한다는 의미는 신속하게 이 탄핵심판을 진행한다는 것이니 협조해달라"고 했다.
또 "봤을 때 필요 이상 말하자면 충분히 할 수 있는데 안 하시거나 이러면 제재하겠다"며 "신속하게 진행하면서도 피청구인 요구 사항을 충분히 반영해 심리할 것이다. 걱정 안 하셔도 된다"고 했다.
